مقايسه‌ي حقوق بيمار در چند كشور پيشرفته و ارايه‌ي الگو براي ايران

Comparison of Patient’s Rights in Developed Countries and Suggestion a Proper Model for Iran

•مقدمه: تاكيد بر حقوق اساسي انسان در مراقبت‌هاي بهداشتي به ويژه حفظ شان بيمار به عنوان يك انسان زماني اهميت مي‌يابد كه آسيب پذيري بيمار، او را به آساني در معرض تخلفات و نقاط ضعف نظام بهداشتي و اجتماعي قرار مي‌دهد. اين پژوهش به منظور مقايسه‌ي حقوق بيمار در چند كشور پيشرفته و ارايه‌ي الگو براي ايران انجام گرفت. •روش بررسي: روش پژوهش در اين مطالعه از نوع توصيفي، تطبيقي و موردي بود. كشورهاي آمريكا (ايالت‌هاي نيويورك، فلوريدا، ميسوري، مينه سوتا و تگزاس)، انگلستان، كانادا و ايران جامعه‌ي پژوهش را تشكيل مي‌ دادند. ابزار گردآوري داده‌ها پست الكترونيكي و سايت‌هاي مربوط به حقوق بيمار بود. گردآوري بر اساس روش جستجوي كتابخانه‌اي انجام گرفت و در كشور ايران علاوه بر آن با استفاده از ابزار پرسش‌نامه -كه روايي و پايايي آن بررسي گرديد-، اطلاعات لازم گردآوري شد. در نهايت پس از تحليل نتايج، الگوي پيشنهادي منشور حقوق بيمار ايران با روش دلفي توسط برخي از متخصصين صاحب‌نظر در اين زمينه آزمون شد. •يافته‌ها: نتايج بررسي بيانگر اين موضوع بود كه حق دسترسي به مراقبت‌هاي بهداشتي و درماني، حق رضايت براي درمان، حق حفظ حريم شخصي و حق حفظ حقوق بيمار (حق شكايت) در بيانيه‌ي حقوق بيمار اكثر كشورها به جز ايران وجود داشت. حق محرمانه ماندن اطلاعات در همه‌ي كشورهاي مورد بررسي وجود داشت. حق استفاده از مترجم و حق تسكين درد، فقط در حقوق بيمار بعضي از ايالت‌هاي آمريكا لحاظ شده بود. در نهايت با استفاده از منشور حقوق بيمار در كشورهاي مورد مطالعه و مقايسه‌ي آن با يكديگر، الگوي پيشنهادي براي منشور حقوق بيمار در ايران ارايه گرديد. •نتيجه‌گيري: به طوركلي مي‌توان چنين نتيجه گرفت كه به علت كاستي‌هاي زيادي كه در منشور حقوق بيمار حاضر در ايران به چشم مي‌خورد، بهتر است بازنگري‌هاي اساسي برطبق بررسي‌هاي تطبيقي صورت گيرد. بر اين اساس، الگويي براي تدوين منشور مناسب حقوق بيمار در ايران پيشنهاد گرديد. •واژه‌‌هاي كليدي: حقوق؛ حقوق بيمار؛ مطالعه‌ي تطبيقي.

Abstract Introduction: In health care, emphasis on basic human rights is especially important. Patient’s privacy protection becomes important when the human is exposed to shortcomings of social and health systems. This study was performed to compare the patient’s rights in developed countries and suggest a proper model for Iran. Methods: This research was a comparative and descriptive case study. Research population included the USA (New York, Florida, Missouri, Minnesota and Texas), England, Canada and Iran. Data collected by internet and e-mail based on a library search method. Furthermore, in Iran, we used a questionnaire that its validity and reliability were tested. Finally, the suggested model of patientʹs rights for Iran was tested by some specialist in this field with Delphi method. Results: Findings of research showed that patients’ rights of accessibility to treatment and health care, privacy, consent for treatment and protection (the right of claim) were included in “patient’s rights” of all studied countries, except Iran. The right of confidentiality is considered in all studied countries. The rights of having translator and pain relief just were seen in some states of the USA. Conclusion: Considering that patient rights have many shortcomings in Iran, generally, main reviews in this field should be performed according to comparative surveys. So, accordingly the appropriate model for developing “Patient’s bill of rights” in Iran was proposed. Keywords: Rights; Patient’s Rights; Comparative Study.
