بررسي فلسفه حكم ارتداد و قلمرو آن در حقوق جزاي اسلام

Review of Apostacy and Its Jurisdiction in Islamic Criminal Law

امروزه حقوق دانان مسلمان،‏ از سويي در عصر جديد كه رويكردهاي حقوقي خاص خود را دارد به سر مي برند،‏ از سويي خويشتن را پايبند موازين و معتقدات ديني خود در اصول و فروع مي يابند. آ يا مي توان در همين دوران حقوق الهي را بهتر درك نموده و موارد تسهيل و تخفيف آ ن را دريافت. اين مقاله با توجه به راهكار مذكور،‏ بطور مستدل در خصوص فلسفه حكم ارتداد و بررسي برخي از موارد قابل تسهيل آن ،‏ با بخش هاي ذيل وارد بحث شده است. ارتداد،‏ احكام،‏ انواع،‏ شرايط،‏ طرق اثبات آ ن،‏ حق حيات،‏ آزادي،‏ حدود آ ن،‏ روش اسلام در عرصه تضارب آرا. ممنوعيت تفتيش عقايد در دين ! اكراه راه به جايي نمي برد. فلسفه حكم الهي ارتداد. سخني با بعضي از فقهاي محترم و بررسي يك راه حل. نتيجه حاوي تبيين منطقي اين حكم و خروج برخي موارد از مصداق عنوان ارتداد و بررسي امكان تفصيل ميان مرتد جاحد و كسي كه بر اثر عروض شبهه مرتد گشته،‏ مي باشد.

Currently, the Islamic Lawers are Living in a unique age which requires its own legal approaches; on the other hand, they persist on sticking to the Islamic beliefs observing both major and minor principles. In this age, then, is it possible to understand the devine law thoroughly and infer its easifying and reducing cases with regard to the above approaches. The present article, focusing on real reason of apostasy and studing the cases which can be easified, argues along the following lines: apostasy and its sentences and kinds and conditions and the ways of proving of it, the right of life and freedom and its limits, the Islamic approach to oppositeness of believes, the illegacy of inspect the believes, there isn’t any compulsion in the religion, real reason of the order of opostasy, studing a solution, conclusion.
