جراحي‌هاي زيبايي؛ ضرورت يا زيادت؟ قولي در ماهيت تعهدات جراحان زيبايي

Cosmetic surgery, necessity or excess? A reference to nature of obligations of cosmetic surgeons

اگرچه در اكثر نظام‌هاي حقوقي و حتي در كشورهاي اسلامي كه بعضاً قوانين آن‌ها برگرفته از فقه عامه است ماهيت تعهدات پزشكي علي‌الاصول تعهد به وسيله معرفي شده است، لكن در برخي موارد خاص و بنابر دلايل معقول و متناسب با ضروريات و نظم نوين حاكم بر جامعه و توجه توامان به نظم و عدالت، ماهيت تعهدات حرف پزشكي تعهد به نتيجه دانسته شده است. در نظام حقوقي ايران علي‌الظاهر به تبع قول مشهور فقهاي اماميه، ماهيت تعهدات پزشكي تعهد به نتيجه معرفي شده است كه اين امر با اين اطلاق قابل انتقاد به نظر مي‌رسد، مع‌هذا پذيرش اين امر ـ به نتيجه دانستن تعهدات جراحان در جراحي‌هاي زيبايي غير ضروري ـ منطقي و منطبق با واقعيات جامعه به نظر مي‌رسد. لذا در اين مقاله ضمن شرح مختصري از پيشينه موضوع و اقوال موافقان و مخالفان، تلاش شده است ماهيت تعهدات جراحان زيبايي با نگاهي مقارنه‌اي و تطبيقي مورد مطالعه قرار گيرد. به همين منظور به بررسي تحليلي ماهيت تعهدات جراحان در مصداق متنازع فيه، متداول و مبتلا‌به آن، يعني جراحي زيبايي ـ اعم از ضروري يا غيرضروري ـ پرداخته شده است.

Although in most legal systems and even in Islamic countries whose codes are drawn from Sunni jurisprudence, the nature of medical obligations is the obligation to means, but in some special cases and according justifiable reasons in accordance with the requirements and the new order ruling the society and regarding to a simultaneous attention to the order and justice, the nature of medical obligations is the obligation to results. Apparently in the Iranianʹs legal system following the majority of Emamyehʹs jurisprudence, the nature of medical obligations has been introduced as the obligation to results which seems be able to criticized. However the acceptance of this subject -obligation to results of the obligation of the surgeons in unnecessary cosmetic surgeries - seems reasonable, logical and consistent with the realities of the society. So in this article, with a brief description of the history of the subject and the views of proponents and opponents, the nature of medical obligations and their examples itʹs been tried to comparatively study. An analytical investigation of the nature of the obligations of the surgeons has been dealt with in some controversial, common and related instances, i.e cosmetic surgery- either necessary or unnecessary-.
