ايمني بيمار و نظام حقوق بشر

Patient’s Safety and the Human Rights System

سلامتي بزرگترين سرمايه بشري است. در اسناد بين‌المللي و حقوق بشري حق بر سلامت انسان در زمره حقوق بنيادين بشري مي‌باشد. از منظر نظام حقوق بشر و بين‌الملل، احقاق اين حق منوط به احترام دول به آن و فراهم آوردن تسهيلات بهداشتي و درماني مناسب جهت بازيابي سلامت افراد بيمار مي باشد. در عين حال اين مساله بسيار حايز اهميت است كه اين نظام حقوقي تا چه حد به امنيت بيمار توجه مي‌كند؟ ايمني بيمار صرفاً منحصر به ارايه مراقبت‌هاي بهداشتي و پزشكي مناسب حين درمان نيست، بلكه از لحظه ابتلاي فردبه بيماري تا پايان مراحل درمان و همچنين پس از آن بيمار در تمام ابعاد زندگي فردي و اجتماعي به عنوان يك شهروند بايد از امنيت جسمي، روحي و اجتماعي برخوردارگردد و نظام حقوقي نمي‌تواند امنيت اين افراد را به خصوص در زندگي اجتماعي و تعامل با اطرافيان (پزشك ومردم) ناديده بگيرد. همانگونه كه اجحاف و تبعيض در حقوق هر انسان به لحاظ نژاد، مذهب، جنسيت و... پذيرفته نيست، ناديده گرفتن حقوق بنيادين يك شهروند همانند حق بر سلامت و درمان مناسب و كافي، حق بر داشتن شغل متناسب با توانايي شخص، حق بر حفظ حريم خصوصي، حق برمصرف كالاي [داروي] سالم تنها به خاطر بيمار بودن او و به خطر انداختن امنيت جسمي، روحي و اجتماعي او به صرف بيمار بودن شخص، امري غيرانساني به شمار مي،رود. حفظ ايمني بيمار به عنوان مهم،ترين حق او در همه زمينه‌هاي زندگي فردي و اجتماعي برعهده تك‌تك افراد جامعه است؛ لذافرهنگ سازي و آگاهي دادن به اقشار مختلف جامعه نسبت به بيمار، ايمني بيمار، نحوه رفتار و تعامل صحيح اطرافيان با او و جايگاه يك بيمار در اجتماع مقدم برهر اقدام ديگري مي‌باشد. در اين نوشته سعي شده است به ايمني بيمار و عوامل تهديدكننده آن توجه شود و برخورد نظام حقوق بشر و بين الملل به اين حق اساسي بيماران يعني حفظ امنيت آنان مورد بررسي قرار گيرد؛ همچنين براين مساله تاكيد گرددكه ما نيازمند مطالعات بيشتر در حوزه ايمني بيمار و چگونگي حفظ آن مي‌باشيم.

The greatest human wealth is health .Declarations on human rights enumerate with one voice the right on health for every human being as one of their fundamental rights. According to human rights and international law the states should respect to the right and provide appropriate therapeutic and hygienic facilities which help to the patient to retrieve their health. Patient safety is not limited just into providing appropriate medical care during treatment process but patient person should receive physical; mental and social safety in all aspects of individual and social life as a citizenship like others from the time a person is infected with disease to the end of treatment process. And the legal system can’t disregard the patient safety particularly in their social life and dealing with other people since having healthy citizens mentally and physically is a necessary requirement of each state. As racial or sex discrimination is not accepted ؛disregarding fundamental rights of a person like the right on health ؛sufficient treatment the right on occupation proportional with ones abilities the right on privacy just because of that person is patient is an inhuman behavior. It should be noticed more in human rights and local statute. Protection of patient safety as the most important right of a patient is a duty should be done by all members of a society therefore awareness to patient safety ؛correct behavior and interaction of other people with a patient are prior to any other measure. In this article tried to be noticed more to the patient safety emphasizing on this issue that we need more inquiry on patient safety and how to manage it.
