Comparative review of the ninety commission & ombudsman institution

امروزه نظارت و كنترل نقش برجسته و غيرقابل وصفي در توسعه و پيشرفت كشورهاي جهان يافته است. يكي از نهادهاي ناظر در نظام حقوقي كشورمان، كميسيون اصل نود قانون اساسي است كه تحت نظر مجلس شوراي اسلامي به «شكايات مردم عليه طرز كار قواي سه-گانه» رسيدگي مي كند. از طرفي در نظام هاي حقوقي مختلف دنيا، يكي از مهم ترين سازكارهاي نظارت و كنترل، تحت عنوان نهاد آمبودزمان به چشم مي خورد كه معمولاً در تعامل با پارلمان، به شكايات شهروندان عليه نهادهاي عمومي و دولتي به شكل غيرقضايي رسيدگي مي كنند. با توجه به شباهت هايي كه در صلاحيت هاي كميسيون و نهاد آمبودزمان به چشم مي خورد، آيا مي توان كميسيون مزبور را به عنوان يك آمبودزمان پارلماني در نظام حقوقي كشورمان پذيرفت؟ باتوجه به اين مهم، مقال حاضر با تعمق در ساختار و كاركردهاي دو نهاد مزبور، شباهت ها و تفاوت هاي ساختاري و كاركردي آن دو را مورد تحليل و بررسي قرار مي‌دهد.

Abstract: Today supervision and control is found prominent and immeasurable role in Countries, development. One of supervisor institutions in our legal system is the principle ninety commissions which consider under parliament, public complaints against the three branches working. On the one hand in the world different legal systems, one of important supervision mechanisms, be seeing under ombudsman institution that usually in interacting with parliament, investigate to citizen complaints against public and state institutions in the non- judicial method. Regarding likeness that seen in the principle ninety commissions and ombudsman institution qualifications, can adopt mentioned commission in our legal system as parliament ombudsman? Due to this important, this paper with meditation in two mentioned institutions structure and function, analyses their Similarities and differences.
