چكيده برخي از حقوقدانان، مفهوم تعهد را به دو عنصر دين و مسيوليت تحليل كرده، جدايي آن دو از يكديگر را ممكن دانسته‌‌اند. تامل در مفهوم حقوقي تعهد و مفهوم فقهي دين، نشان مي‌دهد كه ميان اين دو مفهوم، اختلاف ماهوي مهمي وجود دارد: اولي حكم تكليفي و دومي حكم وضعي است. افزون بر اين، ممكن است اين دو حكم در برخي موارد با هم جمع شوند و ممكن است ميان آن دو جدايي افتد. مقاله حاضر درصدد بررسي اين مسيله است كه آيا تعهد از جهت فقهي امري بسيط‌ است يا مركب و در صورت اخير، از چه عناصري تركيب يافته ‌است؟ اين مقاله با تجزيه تعهد، به دو عنصر وضعي و دو عنصر تكليفي، مي‌كوشد مفهوم تعهد و عناصر آن را در قالب اصطلاحات سنّتي و مانوس وضع و تكليف يا حكم وضعي و حكم تكليفي تحليل كند و آثار اين دو حكم را به اجمال بررسي كند.

Some legalists have divided the notion of commitment into debt and responsibility, and thought that the two might be separated. Reflection upon the legal concept of commitment and the juridical concept of debt shows that the two concepts are deeply different in nature; the former is an obligatory rule while the latter is a provisional one. Furthermore, in some cases, two rules may be agreed, or a separation between the two may occur. The present article is to study that whether commitment is, juridically speaking, a simple point or a compound one; and in the latter case, out of which elements it has been combined. Dividing the commitment into two provisional elements and two obligatory ones, the present article tries to analyze the concept of commitment and its elements in the form of the traditional and familiar terms of provision and obligation or provisional and obligatory rules, and study the effects of the two rules in brief
