Limitations in Access to

عصر انفجار اطلاعات و پيشرفت‌هاي الكترونيكي مصاديق حق دسترسي به اطلاعات را به عنوان يكي از نتايج حق آزادي بيان، توسعه بخشيده است. آزادي بيان مستلزم آزادي در جستجوي فعال اطلاعات، از منابع آن است و اشخاصي كه از حق آزادي بيان برخوردارند؛ بايد از حق دسترسي به اطلاعات نيز برخوردار باشند و لذا آزادي اطلاعات را بايد مقدمه و لازمه تضمين آزادي بيان دانست. پهنه گسترده اينترنت، محدوده آزادي بيان و اطلاعات را تا حدود زيادي گسترش داده و فضاي بي‌انتهايي براي نشر اطلاعات و اخبار فراهم آورده است. يكي از دغدغه‌هايي كه همراه با روند همه‌گيري اين پديده در عالم ايجاد شده است، مسيله نظارت‌ناپذيري و تا حدودي عدم كنترل محتواي آن است. چرا كه هر شخصي مي‌تواند مطالبي را بر صفحه وب قرار دهد كه اين محتوا مخاطباني ميليوني بيابد. از سوي ديگر برخي از انديشمندان غربي با تاكيد بر تيوري‌هاي ليبراليستي معتقدند كه موضوع فيلترينگ اينترنت در تقابل با حق آزادي بيان قرار دارد و البته برخي ديگر نيز، از انديشه‌اي خلاف اين نظريه، جانبداري مي‌كنند. موضوعات مختلفي همچون حفظ اخلاق عمومي، امنيت ملّي، حريم خصوصي و ... سبب شده است تا دولت‌ها مجاب شوند كه بايد به‌طور جدي به مقوله پالايش وب بپردازند.

The age of explosion of information and electronic advances has developed the instances of the right to access to information as one of the consequences of the right of free speech. Freedom of speech requires [the right of] active search of information in the sources; and those who enjoy freedom of speech should enjoy the right of access to information as well. Freedom of information, therefore, should be taken as a perquisite to secure freedom of speech. The extensive scope of internet has strikingly extended the scope of freedom of speech and information, and has provided an unlimited space to disseminate information and news. One of the concerns which has been produced as this phenomenon has been extended to cover all the world is the fact that it cannot be supervised, and its contents are somehow uncontrollable. For, each and every one is able to launch some points in his webpage, and this webpage may find many readers. Some western thinkers who attach importance to liberalist theories are of the opinion that filtering is in conflict with the right of free speech. Some others, of course, advocate the opposite view. Various issues such as protection of public morals, national security, privacy and the like have convinced States to pay serious attention to refinement of the contents of the Web.
