نقش وقف در پيشگيري از بزهكاري و بزهديدگي

The Role Played by Endowment to Prevent Crimes and Being a Victim of Crimes

از جمله آموزه‌هاي سياست جنايي اسلام كه نقش و جايگاه بسيار مهمي در پيشگيري از جرم دارد، نهاد وقف و ترويج فرهنگ وقف است. بررسي ابعاد وقف، به‌ويژه با نظر به وقفنامه‌هايي كه تاكنون كشف شده است و گزارش‌هايي كه از وضعيت جوامع اسلامي موجود است، اثبات‌كننده اين مدعاست كه از جمله كاركردهاي وقف، پيشگيري از بزهكاري و نيز بزهديدگي است. كاركرد نهاد وقف فقط به پيش از وقوع جرم محدود نمي‌شود، بلكه پس از وقوع جرم نيز نقش‌آفريني موثري در كاهش جمعيت كيفري، سازش‌دادن بزهكار و بزهديده و ايفاي نقش ترميمي يا حتي اصلاح و درمان مجرمان دارد. در اين مقاله ابعادي از اين كاركردها بررسي مي‌شود.

One of the doctrines in Islamic criminal policy, which plays an important role to prevent crimes, is the institution of Endowment (waqf) and promotion of the culture of endowment. Study of various aspects of endowment, in particular given the discovered deeds of endowment which are in fact reports made of Islamic societies, proves the claim that one of the functions of endowment is to prevent crimes and being victim of crimes. The function of endowment is not limited to the period before occurrence of crime; even after it, it may play an important role to decrease criminal population, make reconciliation between criminal and his victim, and correct or even cure the criminals. In the present article, some aspects of such functions are studied.
