The Universal Nature of Commitments to Observe Human Rights and the Issue of Condition

در نظام حقوق بشر، تعهدات دولت‌ها در رعايت هنجارهاي اساسي، تعهداتي است مطلق، غيرمشروط و عام در برابر همه دولت‌ها و افراد. ماهيت عام تعهدات حقوق بشري دولت‌ها بدين معناست كه اتيان آنها تابع اصل تقابل و تبادل نيست. مبناي تعهدات حقوق بشري دولت‌ها حمايت از نظم عمومي هنجاري است كه بر رعايت هيچ‌گونه تعهد موازي توسط دولت ديگر توقف ندارد. ماهيت ويژه معاهدات حقوق بشري تاثير مستقيمي بر نتايج شرط‌هاي وارده بر آنها بر جاي مي‌گذارد. نسبت به ميزان تاثير ماهيت عام تعهدات حقوق بشري دولت‌ها بر مسيله شرط، پرسش‌هايي از اين قبيل مطرح است: آيا اساساً اين ماهيت بر قبول و اعتراض دولت‌ها نسبت به شرط تاثير دارد؟ آيا نظام حقوقي شرط بر معاهدات حقوق بشر، صرف‌نظر از ماهيت چنين معاهداتي قابل انطباق است و يا ضروري است چنين معاهداتي از نظامي ويژه در مسيله شرط پيروي كنند؟ نهادهاي نظارتي همچون كميته حقوق بشر در قلمرو شرط چه نقشي مي‌توانند و بايد ايفا كنند؟ آيا از ماهيت خاص معاهدات حقوق بشري مي‌توان حقي براي اين نهادها استنباط كرد؟ نويسنده در اين مقاله ضمن تبيين ماهيت عام تعهدات حقوق بشري دولت‌ها، آثار آن بر مسيله شرط را بررسي كرده است.

In the system of human rights, Statesʹ commitment to observe main norms is an absolute, unconditioned commitment covering all States and individuals. The universal nature of Statesʹ commitments concerning humanrights means that their commitments do not depend on interactions and counteractions. Statesʹ commitments to observe human rights are to support normative public order which does not depend on observance of some other parallel or similar commitment by some other State. The particular nature of commitments concerning human rights has a direct impact on conditions which may be posed for them. About the extent of the impact of universal nature of Statesʹ commitments to observe human rights on the issue of condition, the following questions may arise: "Does this nature influence agreement or disagreement of States about the condition?", "May the legal system of conditions be applied to commitments concerning human of human rights, whatever the nature of such commitments may be?", "Or, is it necessary for such commitments to obey some particular system of conditions?", "Which role could and should the supervising institutions such as the Human Rights Committee play within the scope of condition?", "May some particular right inferred for such institutions from the particular nature of commitments concerning human rights?" In the present article, the author explains the universal nature of Statesʹ commitments concerning human rights, and studies their impacts on the issue of condition.
