Iran’s Legal System and the Issue of Environmental Policymaking

سياست‌گذاري زيست‌محيطي به عنوان يكي از شقوق سياست‌گذاري عمومي دولت، ابزاري حقوقي- سياسي براي مديريت مسايل زيست‌محيطي تلقي مي شود. اما آيا اين نوع سياست‌گذاري در نظام حقوقي ايران مورد شناسايي قرار گرفته است؟ بررسي كلي نظام حقوقي ايران گوياي آن است كه با وجود پيش‌بيني مواردي چون سياست‌هاي كلي نظام در بخش محيط زيست، سند چشم‌انداز توسعه، و قوانين برنامه توسعه، سياست‌گذاري زيست‌محيطي به مثابه تصميم‌گيري زيست‌محيطي تلقي شده است. سياست‌گذاري در عرصه محيط زيست منوط به رعايت بايسته هاي خط مشي‌گذاري عمومي و كاربست راهبردهاي آن مي باشد. بنابراين تصميم گيري نمي تواند واجد عنوان سياست‌گذاري زيست‌محيطي تلقي‌گردد. از اين‌رو، تا وقتي كه نظام حقوقي تكليف خود را با موضوع محيط زيست مشخص ننمايد، سياست تدوين‌شده نمي تواند راهگشاي مشكلات زيست‌محيطي باشد.

Environmental policymaking as a derivative of the government’s public policymaking is a legal and political means for the management of environmental issues. Has this kind of policymaking been actually recognized in Iran’s legal system? The overall structure of the legal system in Iran shows that despite making general policies for environment, as well as attention to environment in the 20-Year Vision Plan and development plan laws, environmental policymaking has been generally considered a form of environmental decision-making. Since environmental policymaking is dependent on public policies and their relevant strategies, environmental decisions cannot be considered as the Iranian government’s policies. Therefore, as long as the Iranian legal system has not reached a final conclusion on environment, the situation of environment in the Iranian legal system is undecided and the current policies cannot help to solve the country’s environmental problems.
