Leasing Contracts and Their Compatibility with Islamic Contracts

با توجه به گسترش روزافزون صنعت ليزينگ در ايران و معاملات گسترده مردم با اين شركتها، ضرورت دارد ماهيت فقهي و حقوقي معاملات شركتهاي ليزينگ مورد توجه قرار گيرد و ضوابط آنها به دقت تبيين گردد. به نظر مي‌رسد اگرچه در تبيين ماهيت حقوقي اين معاملات اختلاف نظر هست لكن مي‌توان با مختصر تغييراتي در قالب قرارداد اجاره و اجاره به شرط تمليك كه مورد قبول فقه اسلامي و مطابق با قانون عمليات بانكي بدون رباست، اكثر آن معاملات را تصحيح كرد.

Due to the increasing expansion of the leasing industry in Iran and the extensive dealings of the people with such corporations, it is necessary to study their legal and fiqhi nature and to make a careful examination of their standards. Although there is disagreement over the legal nature of these transactions, most of them could be justified by making small changes in lease and hire-purchase contracts, which conform to the shariah and correspond to the Interest-Free Banking Operation Act.
