Contemplation on the Jurisprudential foundation of the rehabilitation (General and specific)

نهاد اعاده حيثيت عبارت است از بازگرداندن اعتبار، آبرو و حقوق سلب شده از بزه ديدگان (كليه كساني كه ديگران حيثيت آنها را زايل كرده اند) و مجرمين و رفع كليه محروميت ها ي حقوقي اجتماعي و آثار ناشي از محكوميت قطعي كيفري پس از اجراي مجازات در مدت معين، از سابقه محكوم عليه به صورتي كه در قانون پيش بيني شده است. اعاده حيثيت بر دو گونه است: اعاده حيثيت عام و اعاده حيثيت خاص. گاهي آسيب وارده به حيثيت و تماميت شخص ناشي از عمل ديگران است؛ نظير اشتباه وتقصير قاضي،هتك حرمت (توهين وافترا) قذف و اتهامات واهي( اعاده عام)؛ گاهي نيز لطمه وارده به حيثيت اجتماعي شخص ناشي از عمل خود اوست؛ يعني مجرم با تعرض به مقررات و قواعد جامعه و احيانا تعدي به تماميت مادي و معنوي اشخاص ديگر در واقع به شخصيت و آبروي خود لطمه مي زند و شان و جايگاه اجتماعي خويش را مورد تنزل و بي اعتباري قرار مي دهد( اعاده خاص). اين پژوهش به مباني شناسي ديني اين دو قسم از اعاده حيثيت مي پردازد.مباني مشروعيت اعاده عام، در آيات قران، روايات و حكم عقل و بناي عقلا، وجود دارد و مهم ترين بنيان براي مشروعيت اعاده حيثيت خاص، نهاد توبه است.

The criminal person hurts his reputation by criminal violations of regulations and rules of the society and oppresses other peopleʹs material and spiritual integrity of character degrades his own social status and credit (A restoration). This study examines the fundamentals of religion, these two types of restoring dignity. Restoring the legitimacy of general principles can be found in the verses of the Quran, hadith, and the foundation of reason and rationality. The most important foundation for the legitimacy of certain rehabilitated is repentance.
