بررسي راهكارهاي حل مشكل تاخير تاديه در بانكداري بدون ربا

A Glance at Various Solutions to the Problem of Late Payment in Free-Interest Banking

يكي از مشكلات معاملات مدت‌دار به ويژه در بانكها، تاخير پرداخت ديون است. اين مشكل كه علل و عوامل مختلف دارد، آثار نامطلوب اقتصادي و اجتماعي بر جاي مي‌گذارد. براي حل اين مشكل راهكارهايي پيشنهاد شده است. اين مقاله با مطالعه علل و عوامل تاخير و آثار اقتصادي و اجتماعي آن معيارهايي براي ارزيابي راهكارها ارايه مي‌دهد، سپس با استفاده از آن معيارها به نقد و بررسي راهكارهاي پيشنهادي مي‌پردازد و در نهايت به اين نتيجه مي‌رسد كه برخي از راهكارها مشكل فقهي دارند و برخي ناكارآمدند و نهايتاً هنوز راه حلي كه در عين مشروعيت از كارايي مناسب نيز برخوردار باشد ارايه نشده است و جا دارد با توجه به آموزه‌هاي ديني و كارشناسي راه حلهاي بهتري پيشنهاد شود.

One of the problems of dated transactions especially in the banks is late payment of the debts. This problem, arising from different causes and factors, has adverse economical and social effects, to which various solutions have been offered. Having made a specialist study on the causes and factors of late payment and its economic and social effects, the article offers some criteria for the assessment of these solutions. Drawing upon these criteria, it then makes critique and analysis of the offered solutions and comes to the conclusion that some solutions are of legal or fiqhi difficulty and others have efficacious difficulty and that there have been no solutions which can be both legitimate and efficacious. Therefore, it is reasonable to offer solutions based on religious and specialist doctrines.
