The Philosophy of Punishment

مجازات يكي از قديمي‌ترين نهادهاي بشري است. خصيصه بارز اين نهاد، ناخوشايند بودن آن براي كسي است كه مورد مجازات قرار مي‌گيرد. اين ويژگي فلاسفه را برانگيخته است تا در صدد ارايه توجيهاتي براي آن برآيند. اين مقاله كه در «دايرهالمعارف فلسفه» را‌تليج به نگارش در‌آمده است، مي‌كوشد نظريات فلسفي مختلف راجع به اين مطلب را بررسي نمايد. در ابتدا دو رويكرد آينده‌نگرا يا غايت‌گرا و گذشته‌گرا يا واپس‌گرا مطرح مي‌شود. در رويكرد نخست مجازات به دليل تامين هدفي آتي و نتايج سودمند آن توجيه مي‌شود؛ در حالي كه رويكرد دوم به خطايي كه مجرم مرتكب شده است توجه دارد. هريك از اين دو رويكرد، مظاهر متفاوتي دارد. معروف‌ترين مظهر رويكرد گذشته‌ نگرا نظريه تلافي‌جويانه است كه ايده اصلي آن به يك معنا تاوان جرم است. از جمله مظاهر رويكرد آينده‌نگرا، نظريه تقليل جرايم، باز‌پروري، اصلاح و درمان مورد است كه بررسي قرار مي‌گيرند. در مقابل اين نظريات كه به مجرم توجه دارند، در بخش پاياني مقاله، نظرياتي كه مي‌كوشند مجازات را با توجه به قرباني جرم توجيه كنند مورد بررسي قرار گرفته و دو نظريه ارضاي خاطر و جبران خسارت مطرح شده است.

Punishment is one of the oldest human institutions. The main characteristic of this institution is its being unpleasant for those who are punished. This characteristic provoked philosophers to seek justifications for it. This article, published in Routledgeʹs Encyclopaedia of Philosophy, seeks to examine various philosophical theories on the subject. At first, two approaches are set forth: the forward-looking or teleological approach and the backward-looking or retroactive approach. In the former approach, the justification of punishment is seen as lying in some future goal or useful results which it is hoped will be achieved; in the latter, however, the focus of attention is on the wrong that has been committed by the offender. Each of the two approaches has various manifestations. The best known manifestation of the backward-looking approach is the retribution theory of punishment, the central idea of which is that punishment is in some sense a payment for crime. From the manifestations of the forward-looking approach is discussed: "reductionist theories" and "rehabilitation, reform, and cure". In contrast to these theories, which are primarily concerned with the criminals, the concluding section of the article deals with two theories of punishment which aim to justify the punishment with reference to the victims of the crimes: satisfaction theory and restitution theory.
