از شرايط اساسي صحت عقد اجاره, تعيين مدّت يا تعداد دفعات انجام فعل است, اما گاهي مدّت يا تعداد عمل مورد اجاره به صورت قطعي تعيين نمي‌شود, بلكه طرفين قرارداد ميزان اجرت را در برابر واحد زماني يا دفعه انجام فعل قرار مي‌دهند. فقها وحقوق‌دانان پيرامون صحت و بطلان چنين اجاره‌اي اختلاف نظر دارند. ماده 501 و515 قانون مدني ديدگاه خاصي را پذيرفته است كه بر اساس آن اجاره در اوّلين واحد زماني يا اوّلين دفعه صحيح بوده و در بقيه مدّت يا دفعات موجر يا اجير به موجب مراضات مستحق اجرت به ميزان بيان شده در عقد خواهند بود. نوشته حاضر تلاش مي‌كند ديدگاه‌هاي مختلف در اين موضوع را بررسي كرده و نهادهاي حقوقي را كه امكان جايگزيني با قرارداد مورد اشاره را دارد, تحليل نمايد.

Included in the essential elements of validity of hire contracts is specification of the period of hire (in the hire of things of persons) or the frequency of performing an act (in the hire of persons). Sometimes, however, neither of the alternatives is explicitly stated, but the parties to the contract specify merely a rental or hire charge for a time unit or the first performance an act , leaving the whole duration of hire or the whole number of performing the act unspecified. Islamic jurists and lawyers disagree on the validity of such hire contracts. Articles 501 and 515 of Iranian Civil Code accepted the view that the rents in question are valid for the first time unit or performance, and as to the rest of duration of further performance the leaser or the hired person is entitled to a rental or hire charge equals to the one specified for first time unit or performance. The author tries to study various views on the matter and analysis alternative institutions which may replace unlimited hire.
