چكيده
نظام حقوقي قرآن داراي ويژگي‌هايي است كه جمع آنها در تشريعات بشري وجود ندارد و تا زمان نزول قرآن، بشريت بدان راه نيافته بود و هميشه همراه با ادعاي نبوت و تحدي بوده است.
اعجاز حقوقي قرآن داراي ابعاد متعددي است. ارايه نظام حقوقي ممتاز، هماهنگ، مترقي، مطابق فطرت و مبرّاي از هر گونه خطاي افراطي و تفريطي در عصر جاهلي و ركود فوق العاده فرهنگي؛ تاثير و نقش آفريني ممتاز آن نظام در تحول جامعه؛ نحوه ورود و ارايه تك تك قواعد و دستورات حقوقي به شيوه‌اي بديع به همراه مباني متقن، امري تحير‌آور است. از سوي ديگر، با نظريه‌پردازي‌هاي حقوقي در قرآن مواجه هستيم كه بعد از صدها سال بشر به آن پي برده است و بلكه در مواردي به رغم گذشت قرن‌ها بشر هنوز به رمز و راز تمام ابعاد آنها پي نبرده است؛ لذا اين بُعد زير مجموعه اخبار غيبي است.
از ديگر ابعاد اعجاز حقوقي قرآن، ويژگي‌هاي اساسي موجود در تشريع احكام و نظام حقوقي آن است. مواردي مانند خدا‌محوري؛ ابتناي بر وحي؛ نظام مند بودن مكتب حقوقي قرآن؛ ارتباط قوانين حقوقي با صفات حق تعالي؛ عدالت محوري حاكميت ارزش‌هاي اخلاقي و معنوي؛ مطابقت مقررات با فطرت بشري؛ يُسرگرايي و در حد طاقت بشر؛ بيان عام و پرهيز از ورود به جزييات، تدريج در بيان احكام؛ ابتناي احكام بر مصلحت و مفسده؛ جامعيت؛ عقل‌گرايي؛ پرهيز از وهم و خرافه؛ سبك‌هاي مختلف بيان احكام؛ ضمانت‌هاي اجراي قانون و... از جمله اصولي است كه نظام حقوقي قرآن مبتني بر آن است.
اين نوشتار در راستاي تشريح ابعاد اين اعجاز به صورت اجمالي و با ذكر نمونه‌هايي از اعجاز تشريعي قرآن سامان يافته است.

The legal inimitability of the Quran

Abstract
The legal system of the Quran, comparing to that of human’s legislations, enjoys unique characteristics. These features are not accessible in human-made schools of thought. The human were not aware of them until the revelation of Quran. The Holy Quran has always challenged the human beings and accompanied the prophetic claim. The legal inimitability of the Quran has different aspects such as: presenting a phenomenal, harmonious, progressive, moderate, innovative and inspiring legal system. The very system is exceptionally in harmony with the primordial nature of the human and each of the legal codes and articles is provided with sound foundations. On the other hand we face with many legal theories [theorizations] that the human after centuries have partly realized them and still some secrets of those theories are unclear for them. Thus, this aspect of the Quran is the subdivision of the true prophecies from the unseen world. Another aspect of the legal inimitability of the Quran is the present fundamental characteristics in legislation of the rulings and the specific legal system of Islam. For instance, the Quranic legal system is has taken the following principles into account: monotheism, divine revelation, systematic approach, close relation between legal laws and the divine attributes, the rotation of ethical and spiritual values around justice, the legal codes’ harmony with the human’s primordial nature and abilities. Moreover, the Islamic legal system is based on the following principles: putting forth the general principles and avoiding the particulars, the gradual description of the rulings, the rulings’ establishment on the principle of expediency and corruption, rationality, comprehensiveness, avoiding allusion and superstition, having various guarantees for the laws. The present writing is conducted to describe some miraculous aspects of the Quran particularly the Quranic legislative inimitability.
