Comparative Study of Definition and Registration Criteria of Industrial Designs According to 1386/2007 Act

پس از سال‌‌ها خلا قانوني درخصوص حمايت از طرح‌‌هاي صنعتي، قانون حمايت از اختراعات، طرح‌‌هاي صنعتي، علايم و نام‌‌هاي تجاري، مصوب1386، نتوانست تعريف جامعي از طرح صنعتي ارايه كند. از سوي ديگر، معيارهاي ثبت طرح‌‌هاي صنعتي و ارزيابي آن‌‌ها در قانون، به حدي مبهم و نارسا بود كه آيين‌نامه اجرايي را هم به ورود به حيطه قانونگذاري ناچار كرد تا بتواند با افزودن احكامي بديع، از ميزان چالش‌‌هاي حقوقي در اين زمينه بكاهد. در اين مقاله، به منظور تقليل معايب قانون فوق‌‌الذكر، پس از ارايه تعريفي جامع از طرح‌‌هاي صنعتي و تحليل نقادانه قانون و مطالعه تطبيقي ديگر نظام‌‌هاي حقوقي، راهكارهايي از قبيل اتخاذ همزمان معيار جديد بودن و اصيل بودن در ثبت طرح صنعتي، تصريح به تعريف اصالت در قانون، اصلاح تعريف جديد بودن و... پيشنهاد شده است.

After many years of regulatory gap in protection of industrial design, the act dated 1386/2007 did not manage to provide an exhaustive definition of industrial design. On the other hand, the registration and appraisal criteria of industrial design were too vague that the executive ordinance to trespass the territory of the regulatory power to, by adding some new laws, decrease the related legal challenges. In this article, after giving a complete definition of industrial design; by critical analysis of the above-mention act, some suggestions are provided in order to decrease the actʹs deficiencies, including: simultaneous adoption of both novelty and originality in registration of designs, amending the act by adding a suitable definition of originality in the act, and amending the definition of novelty.
