تحولات ديوان قضايي و تاثير آن بر وضعيت و جايگاه قضات؛از اوايل خلافت عباسي تا تسلط آل‌بويه بر بغداد

The Evaluation of the Juridical Divan and its Effect on the Situation and the Position of the JudgesFrom the Early Abbasids up to the Dominance of Buyids on Baghdad

در ديوان قضايي دولت عباسي دو بخش مجزا وجود داشت؛ سازمان قضا كه با نظارت قضات اداره مي‌شد و ديوان مظالم كه شخص خليفه و در مواردي نايبان او، متولي آن بودند. گرچه به ظاهر وظايف و حوزه فعاليت هر كدام به طور مشخص تعريف شده بود، اما مطالعه منابع تاريخي اين دوره، دگرگوني‌‌‌ها و تحولات بسيار در اين ديوان را نشان مي‌‌‌دهد، تحولاتي كه به نوبه خود، تحول و تغيير در جايگاه، نقش، وظايف و اختيارات و به‌طور كلي وضعيت قضات را در پي داشته است. از جمله تحولات و تطورات ديوان قضايي عباسيان: برخي فرصت‌هاي قضات براي ايفاي نقش در نظام اداري، پيدايش منصب قاضي القضاتي، نقش آفريني در امور سياسي، محدود شدن وظايف قاضي‌القضاتي و در نهايت منسوخ شدن اين منصب و موارد ديگر مي‌باشد. اين پژوهش بر آنست تا با روش توصيفي ـ تحليلي و به استناد منابع و مآخذ تاريخي، به بررسي آن پرداخته و سپس تغييرات متاثر از آن را در وضعيت قضات در ساختار سياسي و اداري حكومت عباسي واكاوي نمايد.

There were two separate parts in the Juridical Divan in Abbasid administration: the organization of judiciary which presides by the judges and Divan of the ma??lim that was in the custody of Caliph and in some cases his lieutenants. Though the tasks and activities of each had been specified, the study of historical sources of that period signifies several changes and transitions in this Divan. These transitions resulted in a reformation and change in position, role, tasks, latitude and generally the situation of the Divan. Amongst the evaluation of the juridical Divan, during the Abbasids, are: opportunities of participating in official affairs, the advent of the supreme judge in administrative system, taking role in political affairs, limitation of the responsibilities of the supreme judge and finally abolish of the supreme judge. Based on descriptive – analytical approach and according to the historical sources, this article will study the above subjects and the evolve in the situation of judges in political and administrative structure of the Abbasid reign.
