چكيده فارسي :
اعمال نفوذ ناروا در حقوق انگلستان همانند اكراه عيب رضا است و به سه نوع تقسيم مي شود: اعمال نفوذ نارواي واقعي، اعمال نفوذ نارواي فرضي نوع اول (روابط خاص مثل والدين و فرزند)، اعمال نفوذ نارواي فرضي نوع دوم (روابط مبتني بر اعتماد واقعي مثل زن و شوهر) در اعمال نفوذ نارواي فرضي نوع اول و دوم آشكارا زيان بار بودن معامله شرط تحقق آن است. اثر اعمال نفوذ ناروا بر معامله در حقوق انگلستان، قابل ابطال بودن قرارداد است. از آنجاكه مقررات اكراه ما سنتي است و جوابگوي نيازهاي امروزي نمي باشد و از سوي ديگر اضطرار نيز موجب بي اعتباري عقد نيست؛ لذا پيشنهاد مي شود كه مقررات اكراه و اضطرار ما اصلاح گردد و از تجربيات كشورهاي ديگر من جمله حقوق انگلستان استفاده شود ولي از آنجا كه تا كنون اين اصلاحات انجام نشده است ما در اين مقاله در صدد برآمديم تحت عنوان معاملات اضطراري اكراهي، دايره اكراه را گسترش داده و دايره اضطرار را محدود نماييم. في ما بين معاملات اضطراري اكراهي در حقوق ايران و اعمال نفوذ ناروا در انگلستان عليرغم وجودتفاوتهاي ماهوي، تشابهاتي نيز وجود دارد.
چكيده لاتين :
From legal point of view the undue influence in English law is comparable to consent defects and into three categories:
Actual undue influence presumed undue influence type1(special relation like the one between parent and child) presumed undue influence type2(relation based on confidential like that existing between husband and wife)
Manifestly disadvantageous is an element in the formation of the last two type.in English law the undue influence makes a contract voidable.Regarding the fact that the regulation on duress in the Iranian law are traditional and do not meet the needs of today s life and that the regulation on necessity too does not make the contract invalid we suggest that reform be made in the duress and necessity regulation taking into considerationthe experiences of other countries likr England.But as these refirms are not made yet an effort has been made in this artiche to expand the domain if duress and restrict that of necessity by what is called here (the duress necessity transactions).though the undue influence and the duress necessity transaction are substantially different there are similarities between the two.
