Codes of Conduct and Prevention of Criminality

مبارزه با بزهكاري از ديرباز يكي از دغدغه‌هاي اصلي بشر بوده و داشتن جامعه‌اي عاري از لوث هنجارشكني‌هاي زيان‌بار، از آرمان‌هاي بلندش به شمار مي‌آمده است. در اين راه، تاكنون انواع تدبيرهاي كنشي و واكنشي آزموده و اجرا شده‌اند. ليكن همواره بازدهي مطلوب راهكارهاي رويارويي با بزهكاري‌ها موردتوجه قرار گرفته است. به همين منظور، چه با نگاه كنش‌مدارانه و چه واكنشي، آن دسته از عوامل بزه‌آفرين نشانه گيري مي شوندكه نقشي حياتي در پيدايش بزهكاري دارند و با برچيده شدن آنها، از شكل‌گيري ديگر عناصر فرايند جنايي و وارد آمدن زيان‌هاي گوناگون به بزه‌ديدگان و آماج‌هاي بزه جلوگيري مي شود. در اين نگاه، انگيزه و آگاهي جنايي، به عنوان سرچشمه بزهكاري و اولويت اصلي نظريه‌پردازان و برنامه‌ريزان سياست جنايي شناخته شده‌اند. چنانچه بتوان اين عناصر را از بين برد، راه براي شكل‌گيري وضعيت‌ جنايي و تحقق رخداد جنايي بسته مي‌شود. براي هدف‌گيري اين عناصر، راهكار مطلوبي كه امروزه در دستور كار نظام‌هاي پيشگيري از بزهكاري قرار گرفته، كدهاي رفتاري است كه با يادآور شدن پيامدهاي بزه براي كنشگران آن، نقش بسزايي در تحقق اهداف اين حوزه ايفا مي‌كنند. ليكن رسيدن به اين دستاورد نيازمند شناسايي جايگاه، كاركرد، سازوكارها و شرايط حاكم بر تدوين و اجراي اين ابزارها و همچنين محدوديت‌ها پيش‌روي آنهاست. در غير اين صورت، ممكن است پيامد ناروا داشته باشند و بزهكاران بالقوه را با انگيزه و توانايي بيشتري رهسپار فرايند جنايي كنند.

Historically, one of the main concerns of human being has been the fight against criminality whose long goal has been to have a society free of harmful abnormalities. In this way, all solutions so far have been taken in to consideration and many proactive and reactive measures have been implemented and tested. But the optimal efficient solution of encountering the criminality has always been taken into account. For this reason, whether having proactive or reactive viewpoint, those factors will be targeted that have a crucial role in the development of delinquency which by getting dismantled will prevent the process of forming another criminal processes and causing the various losses to the victims and crimeʹs targets. In this perspective, the criminal motive and knowledge are known as the source of crime and criminal policy priority of theorists and criminal policy makers. If these elements can be eliminated, there will be no way for the development of the criminal situation and the criminal event. Targeting these elements, a good strategy on the agenda of todayʹs prevention of criminality systems is Codes of conducts which is a reminder of the consequences of crime for actives and plays an important role in achieving the objectives in this area. Achieving this outcome, however, requires the identification of the position, function, mechanisms and conditions governing the formulation and implementation, and also the limitations of these tools. Otherwise, the outcome might have undue consequences that give the potential offenders the motivation and ability of further proceeding to a criminal process.
