The examination of the essential terms of validity of surrogacy agreement in civil law and emamieh jurisprudence

قرارداد جانشيني در بارداري، قراردادي است كه في‌ما‌بين مادر جانشين و زوج نابارور منعقد و به موجب آن مادر جانشين در مقابل زوج نابارور تعهد مي‌كند كه جنين حاصل از لقاح اسپرم و تخمك آن‌ها را در رحم خود پرورش داده و بعد از تولد، نوزاد را به آن‌ها تحويل دهد. براي اعتبار اين قرارداد در حقوق ايران، بايد شرايط اساسي صحت معامله مندرج در ماده 190 ق. م. رعايت گردد. شرايط اين ماده به ويژه در مورد اهليت طرفين و مورد معامله در قرارداد مزبور، مسايل جديدي را ايجاد مي‌كند. اين تحقيق به بررسي اين شرايط پرداخته و اعتبار اين قرارداد را در حقوق ايران اثبات مي‌كند.

The surrogacy agreement is the contract that concluded between the surrogate mother and infertile couple. According to this contract, the surrogate mother, bind against the infertile couple that apply the fetus that created by fertilization of their sperm and egg, grow it in his uterus and give the baby after birth to them. For validity of this contract, in the law of Iran, the essential terms of validity of the contract, in the article of 190 civil law, must be enforced. The terms of this article, especially in relation of the capacity of parties and subject matter, create the new problems in this contract. This research examines these terms and prove the validity of this contract in the law of Iran.
