The Role of the Wasting and Causation Rules in nvironmental Civil Responsibility

آلودگي و تخريب محيط زيست و خسارات ناشي از آن، يكي از معضلات اساسي جوامع صنعتي و شهري امروز و يكي از اصلي‌ترين موضوعاتي است كه در حقوق محيط زيست به آن پرداخته مي‌شود. از اين رو، با توجه به لزوم جبران هر نوع ضرر و زيان در اكثر نظام‌هاي حقوقي، مطالعه و ارزيابي و بحث از مسيوليت مدني ناشي از خسارات زيست محيطي از جايگاه ويژه‌اي در علم حقوق برخوردار خواهد بود. در حقوق اسلام نيز، اصول و قواعد كلي درباره ضمان و مسيوليت مدني وجود دارد كه بسياري از كاركردهاي مبناي مسيوليت مدني را دارا است. اين قواعد كلي جبران خسارت در چهره قواعدي چون اتلاف، تسبيب، لاضرر و...تجلي يافته است كه بخشي ديگر از مباني فقهي مسيوليت مدني زيست محيطي را تشكيل مي‌دهد. در اين نوشتار، از برخي از مهم‌ترين قواعدي كه مي‌تواند ضمان و مسيوليت مدني زيست محيطي را در حقوق اسلام توجيه نمايد، سخن به ميان مي‌آيد.

Pollution and destruction of environment and the resulting damages is one of the basic perplexities of modern industrial and urban societies and one of the most essential issues dealt with in environment rights. Thus, given the necessity of indemnification for any damage and loss in most of the legal systems, the study, assessment, and discussion of civil responsibility arising from environmental damages would enjoy a superior status in law. Similarly, in Islamic law there are general principles and rules concerning indemnification and civil responsibility that contain many of the basic functions of civil responsibility. These general rules of remuneration are manifested in such rules as itl?f (wasting), tasb?b (causation,), l? ?arar (no harm), etc. which construct another important part of jurisprudential principles of environmental civil responsibility. In this writing, some of the most important rules that can justify the environmental indemnification and civil responsibility in Islamic law are put to discussion.
