تبيين و بررسي صحت و فساد از منظر دانشيان اصول

Examining the Truth and Falsehood from the Viewpoint of Legal Theoreticians

امروزه در نوشته هاي اصولي، بحث و تحليل درباره ي صحت و فساد، مركز توجه قرار دارد. همين امر، نياز به تبيين ساختار كنوني بحث صحت و فساد را به صورتي متشكل و منطقي فرا روي مي‌نهد؛ لذا نوشتار حاضر، در راستاي نيل به اين مهم، در پژوهشي توصيفي – تحليلي، متكي بر روش كتابخانه‌اي، با نگاهي مسيله محورانه، مباحث صحت و فساد را در دو بخش مفهوم شناسي و حكم شناسي مدون مي سازد و به بيان و بررسي ديدگاه‌ها و استدلال‌هاي دانشيان اصول درباره ي مباحثي همانند: معناي صحت و فساد، تقابل، معروض و گونه هاي صحت و فساد و نيز انتزاعي، عقلي يا جعلي بودن صحت و فساد و تفصيل‌هاي مطرح شده، مي‌پردازد و بدين ترتيب، افزون بر هويدا ساختن سامان كنوني و منطقي بحث، به نشان دادن سير تكوين بحث نيز نظر دارد.

Nowadays, discussion about and analysis of sihha (truth) and fasad (falsehood) is a focus of attention in theological (usuli) writings. This issue necessitates an explanation of the present structure of the discourse of sihha and fasad in an integrated and logical way. Thereby, to achieve this important task, the present article undertakes a descriptive-analytical research based on a library-method and with a problem-oriented view, and formulates the discourses of sihha and fasad into two fields of conceptology and study of legal decisions and goes on to express and study the viewpoints and arguments of the legal theoreticians (usul scholars) concerning such discourses as: the meaning of sihha and fasad; opposition (taqabul), contradiction (ma‘ruz), and variations of sihha and fasad; and also the abstractness, rationality, or fabricatedness of sihha and fasad and the propounded details. Thus, besides unveiling the present logical arrangement of the discourse, it proceeds to indicate the course of development of the discourse, as well.
