سنجش از دور در نظام حقوقي ملي و بين‌المللي

Remote Sensing in National and International Legal System

سنجش از دور به دليل كاربردهاي مختلف آن، اهميت عمده‌اي در حوزه‌هاي كاربردي علوم و فناوري‌هاي اطلاعات زمين دارد. با توجه به اهميت حقوقي اين علم و فناوري براي جامعه كاربران، در اين مقاله جنبه‌هاي حقوقي آن در بستر معاهدات و كنوانسيون‌هاي بين‌المللي و قوانين ملي مورد كنكاش قرار گرفته است. مقاله حاضر ضمن تبيين ماهيت و ابعاد حقوقي ملي و بين‌المللي سنجش از دور هوايي (فتوگرامتري)، به بررسي اسناد بين‌المللي مربوط به فعاليت‌هاي فضايي (سنجش از دور) مي‌پردازد. در اين حيطه، ضمن مطالعه و بررسي معاهدات بين‌‌المللي مربوط به فعاليت‌هاي فراجوّي، مهم‌ترين اصول حقوقي حاكم بر سنجش از دور ماهواره‌اي نيز تبيين مي‌گردد. به‌رغم اهميت موضوع، جايگاه اين حوزه از علم و فناوري هنوز در حقوق ملي و بين‌الملل تثبيت نشده است. با توجه به نتايج بررسي‌هاي دقيق اين تحقيق، مواردي از كاربردهاي حقوقي اين ابزار علمي و فني ـ نظير استنادپذيري قضايي داده‌هاي ماهواره‌اي در برخي از نظام‌هاي حقوقي ـ بررسي و در اين تحقيق بيان شده‌اند، كه نمونه‌هايي از كاربرد فناوري مذكور در فرايندهاي قضايي و حقوقي به‌شمار مي‌آيند.

Abstract The remote sensing, because of its wide-range application, plays a crucial role in earth sciences and technologies. Regarding legal significance of it in human life, its legal aspects have been analyzed within international treaties and conventions, as well as the national laws. In this paper the legal aspects of areal photogrammetry and satellite-based remote sensing have been surveyed. In addition to considering legal nature and aspects of aerial remote sensing, this article investigates the international documents on space activities (relating to remote sensing) and the most important legal principles governing the mentioned category, and tries to clarify the situation of it in international laws. Despite the high importance of the topic, the legal national and international situations of it are not clearly explained. Based on the obtained results of this research work many aspects of the remote sensing have been explained, such as: the reliability of satellite remote sensing data, and applicability of intellectual property law to them. The mentioned cases are among the samples of usability of remote sensing in judicial and legal processes.
