Legal Acts of Discerning Minor

در مقدمه اين مقاله، ضرورت بحث پيرامون «اعمال حقوقي صغيرمميز» را تبيين نموده ايم. سپس مباحث مربوط را به دو مبحث تقسيم نموده و در ذيل هريك متناسب با عنوانِ منتخب، مطالبي را از نظر گذرانده ايم. در مبحث اول ذيل عنوانِ«مفاهيم و تعاريف» اصطلاحات عنوانِ مقاله يعني «صغيرغيرمميز» و «عمل حقوقي» را تعريف كرده ايم. براي مبحث دوم، عنوانِ «بررسي اعمال حقوقي صغيرمميز» را برگزيده ايم و در ذيل گفتار اوّل آن، «اعمال حقوقي بالاصاله صغير مميز» را از حيث صحت، بطلان و عدم نفوذ، از منظر حقوق موضوعه، فقه اسلامي و ديدگاه بر خي از كشورها بررسي نموده ايم. در گفتار دوم، راجع به «انجام اعمال حقوقي صغيرمميز به نيابت و نمايندگي» سخن گفته ايم و در ذيل آن، از نمايندگي وليّ قهري، قيم، وصي و امين، در مقام انعقاد معاملات و انشا اعمال حقوقي و محدوديتهاي هريك از نايبينِ مذكور، گفتگو به عمل آورده ايم.

In this paper, we have clarified the p.ecessity and motivation about legal act of discerning minor. After this introduction, we have classified related subjects into two topics and here we have investigated each one of them. In first topics of concepts and definitions, discerning minor and legal acts have been investigated. For second topic, we have selected legal acts of discerning minor and have investigated legal acts based on discerning minor from correctness and veracity, invalidity and impermeability, Islamic religious laws points of views and also we have investigated views of some countries in this respect. In second parts, we presented doing legal acts of discerning minor as representation and after that we have talked with p.atural guardian, trustees, and executor of will in position of signing a contract and doing legal act and restriction of mentioned representations
