شخصيت حقوقي بين‌المللي اينترپل

در فضاي حقوق بين‌المللي شخصيت حقوقي عبارت است از: صلاحيت دارا شدن حقوق و تكاليف براي موضوعات غير انساني. شخص حقوقي از نظر علم حقوق قابليت برخورداري از حقوق را دارد، تكاليف قانوني بر عهده مي‌گيرد، اعمال حقوقي انجام مي‌دهد، اقامه دعوا مي‌كند، تحت تعقيب قرار مي‌گيرد و مسيول اعمال خود شناخته مي‌شود. شخصيت حقوقي در هر نظامي تابعي است از متغير ملاحظات مختلف سياسي، اقتصادي، اجتماعي و سيستماتيك مربوط به آن نظام حقوقي. در نظام‌هاي داخلي، قانون‌گذار به اعتبار حاكميت دولت، با توجه به نيازهاي اجتماعي، نهادهايي را به عنوان شخص حقوقي تلقي كرده، شناسايي آن را به افراد و نهادهاي تحت حاكميت خويش تحميل مي‌كند. از اين رو اينترپل به عنوان سازماني بين‌الدولي تنها در صورتي مي‌تواند داراي حقوق و تكاليف بين‌المللي شود كه داراي شخصيت حقوقي بين‌المللي باشد. اين نوشتار بر آن است كه با توجه به گسترش روز افزون فعاليت‌هاي و افزايش نقش اينترپل، روشن سازد آيا اينترپل داراي شخصيت حقوقي عيني و اهليت حقوقي ذاتي براي اجراي هر گونه اقدام بين‌المللي مي‌باشد و يا حقوق و تكاليف اينترپل محدود به اهداف، وظايف و اختيارات صريح يا ضمني است كه در سند تاسيس آن ذكر شده است و در هر صورت شخصيت حقوقي اينترپل داراي چه آثاري است؟

In the international legal arena a legal entity means authorization of rights and duties for non-human subject. In the Law sciences, a legal entity enjoys rights, undertakes law obligations, does legal actions, files a lawsuit, gets under prosecution and is also in charge of its own acts. The Legal entity in each government depends on political, economic, social and systematic variables of the legal system. By authorization which is in possession of the government, law makers in internal regimes by considering social demands adopt some institutes as legal entities and then impose them on its ruling entities. Therefore, the International Criminal Police Organization, INTERPOL, as an inter-governmental organization may only have international rights if it enjoys an international legal entity. By increasing trends of Interpol functions and activities this article aims to clarify the issue of whether Interpol has an objective and inherent law capacity to enforce its international actions. The Interpol rights are limited to some goals, obligations and implied power included in its Constitution. Moreover, it aims to investigate the Interpol legal entity.
