Comparative Study of Embryo Donation from Viewpoint Of Medical Ethics and Medical Law

با تولد اولين نوزاد ناشي از لقاح خارج رحمي در سال 1978م.، آگاهي مردم از روش‌هاي جديد درمان ناباروري افزايش يافت. به كارگيري اين تكنيك‌ها اميد را براي گروهي از زوج‌ها ـ كه پيش از آن تصور مي‌كردند هرگز صاحب فرزند نمي‌شوند ـ به ارمغان آورد. از جمله اين روش‌ها، اهداي تخمك، اسپرم و جنين است كه به عنوان «باروري جايگزين» و يكي از راه‌هاي موفق درمان ناباروري مطرح شده است. «اصول باروري جايگزين» و شرايط آن در قانون و آيين‌نامه‌هاي اجرايي مربوط آمده است؛ اما آنچه در اين ميان حايز اهميت است، اطمينان از سلامت اهداكننده، دريافت‌كننده و تطابق خصوصيات و ويژگي‌هاي ظاهري، خوني، فرهنگي، اجتماعي و ديني است. اولين اقدام در اين زمينه آگاهي زوجين از چگونگي دريافت گامت يا جنين اهدايي است تا نگراني‌هاي حاصل از اين عمل، خطرات احتمالي، درصد موفقيت، هزينه‌هاي مربوطه، مسايل شرعي و قانوني متعاقب آن، محرمانه بودن هويت‌دهنده و گيرنده از يكديگر و سلامت گامت يا جنين مورد ارزيابي قرار گيرد. اين روش‌هاي نوين در كنار جنبه‌هاي درماني، ابعاد حقوقي و اخلاقي پيچيده‌اي دارند كه براساس شرايط فرهنگي، اجتماعي و اعتقادي هر كشور نيازمند دقت نظر خاص بوده و بايد مورد توجه قرار گيرند.

The knowledge of people about new methods of Infertility`s treatment increase by birth of first child born from invitro fertilization method in 1978. Use of these methods brings hope for many couples that think they never can have a baby. Some of these methods are egg donation, sperm donation and embryo donation that have been introduced as ʹʹsurrogate pregnancyʹʹ and one of the best method of Infertility`s treatment. ʹʹprinciples of surrogate pregnancyʹʹ and its stipulation is mentioned in relevant statutes and executive regulations, but the important issues are the certainty of healthiness of donor and donee and conformity of outwards, bloody, social, cultural and religious features and patterns. First thing in this matter is awareness of couples about the condition of the gamete and Embryo donation so that the possible risks, percentage of success, relevant costs, subsequent legal and jurisprudential Issues, secrecy of the donor and donee`s identity and healthiness of gamete and embryo can be evaluated. These new methods along with the therapeutic aspects have complex ethical and legal aspects that need to be gazed and regarded in the respect of religious, social and cultural conditions of each country.
