تفسير فقهي اهل بيتعليهم السلام از قصه‌هاي قرآني و رهيافت‌هاي آن

Jurisprudential interpretation of Story verses of The Quran in The School of Household of the Prophet (AS) and its Consequences

بخش زيادي از قرآن روايت داستان امّت‌هاي پيشين و انبيا الهي است. جايگاه و نقش اين داستان‌ها به‌عنوان يك منبع فقهي از جمله مباحث نظري آيات احكام است. ‌از آنجايي‌كه زبان داستان زبان اخبار است اين پرسش در بين فقيهان و مفسّران همواره مطرح بوده است كه آيا آيات قصص مي‌تواند مفهوم انشايي داشته باشد؟ آيا مي‌توان از قصص قرآن احكام فقهي را استنباط كرد؟ در بخش اول اين مقاله رواياتي ذكر كرده‌ايم كه در آنها اهل بيتعليهم السلام از آيات داستاني براي استنباط احكام استفاده كرده‌اند. در بخش دوم به رهيافت‌هاي مستخرج از روش اهل بيتعليهم‌السلام در تفسير فقيهانه از قصص قرآني پرداخته‌ايم و نشان داده‌ايم آيات داستاني از جمله منابع قرآني براي احكام فقهي است.

- The major part of the Quran is the story of ancient nations and Divine prophets. The role of these stories as a jurisprudential source is the theoretical topic in juridical verses. The stories have descriptive language, so the question has always been among jurists and commentators that the story verses can be have normative function? Does it Islamic jurisprudence be inferred from the Quranic stories? In the first part of this article we have mentioned hadiths to show that household of the Prophet (AS) infer legal rules from stories of the Quran. In the second part we have discussed consequences and issues of their method in Jurisprudential interpretation of Quranic stories and have showed that the story verses are a source for the Islamic jurisprudence.
