A Jurisprudential Review of the Nature of the Right

بحث در زمينه "ماهيت حق" در فقه، از جمله مباحث پايه‌اي و بنيادين در استنباط است كه شناخت لازم نسبت به آن مبناي بسياري از احكام و قوانين مستنبط از ادله در خصوص حقوق قرار مي‌گيرد و در اين‌باره تاكنون، به لحاظ اهميت مساله نظريات و آراي متعددي ارايه گرديده است؛ اما اين نكته مطرح است كه آيا تحقيقات و تاملات صورت گرفته، به نظريه‌اي بلامنازع وعاري از اشكال منتهي گرديده و انتظار پژوهشگران وصاحب نظران عرصه فقه و حقوق را در اين زمينه پاسخ در خور داده است يا خير؟ اين نوشتار از ميان نظريات مختلف در اين‌باره، نظريه "بنيادين سلطنت" با انحاي مختلف آن و نظريه‌هاي "ملكيت و سزاواري" را كه از سوي جمعي از فقيهان مطرح گرديده، نقادي نموده است و نظريه "اعتباري بودن حق" را با در نظر گرفتن تاثير عناصري كه بر تكوين حق و اعتبار آن نقش دارند؛ وجه جامع ميان همه حقوق دانسته است.

The discussion about "the nature of the right" in jurisprudence is one of the fundamental subjects in the deduction which its understanding bases many laws and regulations which are deduced from reasons concerning the rights; and in this case until now, several theories have been presented in terms of the importance of this subject; but the question is that have these efforts led to a perfect and accurate theory and met the expectations of the scholars and experts in the field of the Islamic jurisprudence appropriately or not? This article has criticized the theory of "the fundamental reign" with its different ways and the theory of "the ownership and the worthiness" brought up by some of jurisprudents, and has regarded the theory of "the creditability of the right" considering the elements influenced on the right and its credit as a common point.
