تعهدات دولت‌ها در قبال حق بر غذا با توجه به ماده يازدهم ميثاق بين‌المللي حقوق اقتصادي، اجتماعي و فرهنگي

OBLIGATIONS OF STATES REGARDING THE RIGHT TO FOOD, ACCORDING TO ARTICLE XI OF THE INTERNATIONAL COVENANT ON ECONOMIC, SOCIAL AND CULTURAL RIGHTS

در چارچوب حقوق بين‌الملل، حق بر غذا، حق بنيادين هر شخص بر دسترسي پايدار به غذا به‌گونه‌اي‌ست كه پاسخگوي نيازهاي غذايي وي باشد. با توجه به جايگاه ويژه‌ دولت‌ها در حقوق بين‌الملل، بررسي تامين حق بر غذا به عنوان يكي از تعهدات دولت‌ها از اهميت خاصي برخوردار است. پرسش اصلي آن است كه اساس حقوقي تعهدات دولت‌ها در زمينه حق بر غذا چيست و چگونه بايد به اين تعهد عمل كنند. در اين مقاله نشان داده ‌مي‌شود كه مبناي حقوقي تعهد دولت‌ها نسبت به حق بر غذاي كافي برگرفته از اسناد بين‌المللي حقوق بشري به ويژه ميثاق بين‏المللي حقوق‏ اقتصادي، اجتماعي و فرهنگي ست. همچنين در اين مقاله بيان مي‌شود كه مهم‌ترين روش‌هاي تحقق حق بر غذا، تدوين استراتژي‌هاي ملي، قانون‌گذاري و اقامه‏پذيري حق بر غذا مي‌باشند. نهايتاً نتيجه‌گيري مي‌شود كه براي تحقق حق بر غذا، دولت‌ها بايد به تعهدات خود در سطوح ملي و بين‌المللي عمل كنند.

In the framework of international law, the right to food is a fundamental right of person towards having sustainable access to food with the quality which responds to his/her food needs. With due respect to the special position of States in international law, it is importance to examine their obligations regarding the right to food. The principal question is that what constitutes the legal basis of such obligations. In this paper, it is demonstrated that the legal basis of these obligations originates from the international documents on human rights, particularly, the UN Covenant on Economic, Social, and Cultural Rights. In addition, this paper examines the most important mechanisms for realization the right to food, including designing national strategies, legislating and providing legal ways to guarantee the right to food. This paper concludes that if the right to food is to be fulfilled, States should observe their obligations nationally and internationally.
