مرجع امنيت ملي جمهوري اسلامي ايران در رويكرد حقوقي

مرجع امنيت هسته اصلي و نقطه كانوني مباحث امنيتي را تشكيل مي‌دهد. اين مقاله با هدف بررسي و شناسايي مرجع امنيت جمهوري اسلامي ايران در رويكرد حقوقي به نگارش درآمده است. براي نيل به اين منظور قانون اساسي به عنوان اصيل‌ترين منبع حقوقي نظام اسلامي ايران كه بازتابنده آمال، آرمان‌ها، اصول و ارزش‌هاي نظام است مورد بازخواني، واكاوي و تحليل قرارگرفته است. طبعاً چگونگي فهم مرجع امنيت از اين متن حقوقي بايد تابع شاخص‌هايي باشد. در اين راستا ضمن بهره گيري از شاخص‌هاي ارايه شده در ادبيات امنيتي، اين مشخصه‌ها كافي دانسته نشده و علاوه بر آنها سه شاخص ديگر بدست داده شده است كه عبارتند از: ارتباط مرجع امنيت با ارزش‌هاي بنيادين، تكرار و تاكيد بر برخي گزاره‌ها در قانون اساسي، و ارتباط وثيق مرجع امنيت با اهداف نهاد سياست گذار امنيتي. با استفاده از اين شاخص‌ها ضمن بررسي گزاره‌هايي كه مي‌توانسته‌اند به عنوان مرجع امنيت محسوب شوند، سرانجام دولت به عنوان مرجع امنيت ملي جمهوري اسلامي ايران در رويكرد حقوقي معرفي گرديده است. بر اين مبنا مرجع امنيت در نگاه قانون اساسي موضوع واحدي است و نه متكثر. در تلقي امور متعدد به عنوان مرجع امنيت، از آنجا كه تهديدات متعددي در ارتباط با هر يك از مرجع‌ها مي‌تواند مطرح شود، در نتيجه سياست‌گذاري امنيتي نمي‌تواند از فراز و فرود، قبض و بسط ونوسان مصون بماند. اما با تلقي امر واحد به عنوان مرجع امنيت، چنين تشتتي در امر سياست‌گذاري و تصميم گيري امنيتي پيش نخواهد آمد.

The source of security shapes the main core and focal point of security discussions. The aim of current paper is studying and identifying the source of national security of the I.R. of Iran in legal approach. For achieving this aim, the constitution as the most basic legal source of the Islamic system of Iran which reflects the aspirations, principles and values of system has been redefined, investigated and ananlysed. Naturally, the way of understanding the security source from this legal text should be subordinated to indicators. In this line, while introduced indicators in security literature have been used, those indicators have not been understood as enough indicators and in addition to them, more three indicators gained including: the relation of security source to fundamental values, repetition and emphasis on some predicates in constitution and authentic relation of security source to the aims of security policy maker body. By using these indicators, while the predicates which could be considered as security source were studied, finally the government as the national security source of the I.R. of Iran in legal approach has been introduced. In consideration of various affairs as security source, since different threats in relation of any source could be raised, as a result, the security policy making could not be excluded from ups and downs, expansion and contraction as well as fluctuation. But through an individual case as the source of security, such diversities would not happened in policy making and policy maker.
