يكي از شرايطي كه در تحقق عنصر مادي همه جرايم عليه اموال لحاظ مي شود، تعلق مال به غير است. ازجمله مباحثي كه ذيل اين شرط مطرح مي شود اين است كه آيا اشاعه مانعي براي تحقق عنصر مادي اين جرايم هست يا نه؟ در اين مقاله بادرنظر گرفتن مبناي جرم‌انگاري جرايم عليه اموال، تفسير دقيق عنصر اشاعه در كنار عنصر معنوي،بررسي رويه قضايي و نظرات مشهور فقهاي اماميه در باب سرقت مال مشاع، به اين نتيجه رسيده ايم كه عنصر اشاعه خللي به عنصر مادي جرايم عليه اموال وارد نمي سازد و به‌يقين امكان تحقق جرايم عليه اموال مشاع با توجه به مقررات فعلي وجود دارد.

One of the conditions which is realized for the actusreus of all offences against property is the ownership of the property by another person.One of the discussions which follows the mentioned condition is: “Is the element of co-ownership an obstacle for the realization of the actusreus of offences against property or not?” In this article, with regard to the basis of commiting an offence in offences against property, the exact interpretation of the principles of co-ownership next to the mensrea, review of judicial procedure and views of the celebrated religious jurisprudence of the Imams about the marginal theft of the joint property, we have come to the conclusion that the principles of co-ownership do not damage the actusreus of the offences against property and there certainly is a possibility to fulfill the offences against joint property in regards to the present provisions.
