بررسي رابطه قانون مناسب و اقتدار اجتماعي

Proper law and social authority

مقاله حاضر با هدف بررسي رابطه «قانون مناسب» و «اقتدار اجتماعي» انجام گرفته است تا با شناخت اين رابطه، به اهميت يكي از مهمترين عوامل تاثيرگذار بر اقتدار اجتماعي كه همانا قانون مناسب است، پي برده شود. روش تحقيق مطالعه حاضر، روش پيمايشي با تكنيك دلفي است كه با بهره گيري از داده هاي پرسشنامه در 3 مرحله، نظر صاحب‌نظران اين حوزه را در اين باره جمع آوري شده است. نمونه مورد استفاده در اين تحقيق 55 نفر شامل صاحبنظران حوزه نظم و امنيت با حداقل مدرك تحصيلي دانشجوي دكتري و با بيست سال سابقه كار، مستقر در شهر تهران است. يافته هاي تحقيق نشان مي دهد كه قانون مناسب بيشترين تاثير را بر شاخصهايي از اقتدار اجتماعي به شرح؛ مشروعيت و شايستگي حكومت، اعتماد عمومي، رضايت‌مندي عمومي و مشروعيت سياستها و قوانين داشته است. همچنين شاخصهاي قانون مناسب كه بيشترين تاثير را بر اقتدار اجتماعي داشتهاند، به ترتيب شامل تامينكننده عدالت در جامعه، تامينكننده منافع عمومي، توان پاسخگويي به نيازها، انطباق با مباني دين اسلام و برخورداري از ضمانت اجراي قوي هستند.

This paper aims to investigate the relationship between "proper law" and "public authority". It is argued that by understanding this relationship, the importance of social authority as one of the most important factors influencing the proper law, would be realized. Research Methodology of the present study is survey research with Delphi technique. By using data from the questionnaire in 3 Phases, the opinions of experts on this relation have been collected. a sample of 55 people, including order and security experts with a minimum of PhD degree and twenty years of experience based in Tehran, has been used. The Findings suggest that the proper law has had the greatest impact on indicators of social authority such as legitimacy, competence of government, public trust, public satisfaction and the legitimacy of public policies and laws. The results show that indicators of proper law having the greatest impact on the social authority, respectively include justice in society, public interests, responsiveness of the government to needs, adaptation to the principles of Islam and strong guarantees.
