The Backgrounds That Can Contribute to Realizing Economic Jihad in the Constitution

قانون اساسي، مهم‌ترين عامل تعيين‌كننده سمت و سوي حركت اقتصادي، سياسي، اجتماعي و فرهنگي هر كشور است. در قانون اساسي، اصول كلي نظم عمومي جامعه و پيوندهاي بين حاكميت و مردم، به صورت ارتباط دو سويه مبتني بر حق و تكليف، پايه‌ريزي مي‌شود و نتيجه عمل به آن، رسيدن به ارزشها و هنجارهايي است كه به عنوان آرمانها و اهداف، در قانون اساسي مدّ نظر قرار گرفته‌اند. به منظور تبيين زمينه‌هاي قانوني جهاد اقتصادي، ضروري است كه با بررسي و تحليل قانون اساسي به ويژه اصول اقتصادي آن، زمينه‌هاي موجود براي كمك به تحقق جهاد اقتصادي شناسايي شوند. لذا پرسش اساسي مقاله حاضر اين است كه زمينه‌هاي تحقق جهاد اقتصادي در قانون اساسي جمهوري اسلامي ايران كدامند؟ قانون اساسي، سند مهندسي طراحي و اجراي نظام اقتصادي كشور است و در شرايط ويژه و موقعيتهاي خاص، از جمله شرايط جهادگونه، خطوط كلي حركت را مشخص مي‏كند. بنابر اين الزامات اقتصادي كه قانون اساسي مشخص مي‏كند در دو سطح قابل بيان است: سطح اول، اهدافي را در بر مي‏گيرد كه جهادگران اقتصادي بايد براي تبلور و عينيت يافتن آن در جامعه تلاش كنند؛ همچون: عدالت اقتصادي و اجتماعي، كرامت انساني و استقلال اقتصادي. سطح دوم، راههاي مورد نظر قانون اساسي را كه جهادگران بايد با گذر از آنها به اهداف مذكور دست‏يابند، مطرح مي‏كند؛ از جمله: تعاون و همكاري اجتماعي، كسب دانش و داشتن روحيه ابتكار و نوآوري، نظارت همگاني و كنترل اجتماعي.

The Constitution counts as the most important factor that determines the courses of political, economical, social and cultural movements in the country. In the Constitution, the general principles governing public order in the society and the bonds between people are configured in the form of a mutual relationship based on ‘right and obligation’, where practicing them would lead to values and norms that have been taken into account as ideals and objectives in the Constitution. In order to explain the legal backgrounds for economical Jihad, it is necessary that the existing factors that can contribute to realizing economic Jihad be identified by studying and analyzing the Constitution, specially its economic principles. So, the main question in this article is “what are the backgrounds that can contribute to realizing the economic Jihad?” The Constitution is the instrument for designing and implementing the economic system in the country, specifying the broad outlines of the planned movement in specific situations and conditions, including Jihad-like ones. It follows that economic requirements as specified in the Constitution can be explained on two levels: The first level includes objectives including economic and social justice, human dignity and economic independence for the achievement of which economic Jihadists should work hard. The second one sets out the strategies as intended by the Constitution- including social cooperation, acquiring knowledge and fostering a spirit of initiative and innovation, public supervision and social monitoring- the achievement of which requires Jihadists to achieve the objectives set out in the first level.
