A Study of Resistance in the Light of International Law

تعريف مقاومت و به عبارتي؛ مبارزات آزادي‌بخش، در حقوق بين‌الملل عمومي مشمول جامعيت كافي نيست. در واقع؛ اين اصطلاح در تقابل با تروريسم، در هر محفل بين‌المللي ذي‌ربط تفرقه‌انداز بوده، باعث عدم ارايه تعريفي واحد از اين اصطلاح شده است. گر چه در اسناد حقوقي مهمي به اين مقوله اشاره شده است؛ ولي با وجود اين، هنوز در نظر برخي از دولتها از مشروعيت برخوردار نيست. اين نوشتار، ضمن بررسي مشروعيت مقوله مذكور از منظر حقوق بين‌الملل، به بيان حق مبارزه مسلّحانه نهضتهاي مقاومت براي اعمال حق تعيين سرنوشت پرداخته، تمايز آن را با جدايي‌طلبي كه اعمالي تروريستي معرفي مي‌شوند، تبيين و عوامل خلط اين دو را بررسي كرده است.

What international law gives as the definition of liberation fightings is not comprehensive enough. In fact, as opposed to terrorism, this concept is divisive in any relevant international forum, preventing an integrated definition of this concept. Although it has been referred to in important documents, a few of states are still deeming it as illegitimate. This writing, while studying the legitimacy of the mentioned category from the perspective of international law, has set out to point out the resistance movements’ right to wage an armed struggle to exercise their right to self determination, explained the difference between the concept of resistance and that of separatism and … which are introduced as terrorist actions, and explored the confusion between these two.
