تامّلي حقوقي بر پاره‌اي از مولفه‌ها و كارويژه‌هاي بسيج در عرصه اجتماع

A Legal Analysis on the Major Functions and Chractrestics of the Basij within the Community

زيست جمعي، يكي از خصايص فطري انسان، و جامعه، بستر همزيستي آنها و تابع ملاحظاتي خاص (طبيعي، انساني، ثابت، پويا، هنجاري، معرفتي) است. جلوگيري از آشفتگي و تضمين نظم اجتماعي (به عنوان كلي ترين گستره‌اي كه به نوبه خود، تعيين كننده نظم حقوقي است) مستلزم توجه دقيق به ملاحظات مذكور، اعم از درك مناسبات اجتماعي و مديريت عملي و عيني آنها و هنجارهاي ناظر بر شكل‌گيري و تحوّل مناسبات مذكور است. بسيج، نهادي در بطن اجتماع است كه از جهت شكل گيري متاثّر از مناسبات مذكور بوده و از حيث كاركردي نيز با عمده‌ترين بخش از كنشهاي متقابل اعضاي اجتماع سروكار دارد و از اين حيث، تجسّم تلاقي يا تاثير و تاثّر نظم حقوقي و اجتماعي است. شناخت علمي اين مناسبات، به تحكيم روند ارتقاي كاركردهاي بسيج در مديريت امور عمومي خواهد انجاميد. در اين نوشتار، ضمن تحليل مباني حقوقي شكل گيري بسيج و تحوّل و تحرّك آن به عنوان نهادي موثر بر مديريت و هدايت نظم اجتماعي، نقشها و كارويژه‌هاي بسيج را در اين خصوص از منظر حقوقي تحليل خواهيم كرد.

Coexistence or collective life is a principal natural character of the human being, and the society or community inspite of governed by the different considerations (natural, human, stable, dynamic, normative), is the necessary place to the co-existense. Insuring the social order and preventing disorders will depend on respect for that consideration for example understanding the social relations, thier practical management and enforce the social norms. The Basij in lirht of creation process and functions is a major social institution of the Islamic Republic of Iran who organizes the social relations and formed objectively correlations and interdependence of the legal and social orders. Therefore, comprehensive understanding of the Basij’s social functions will enhance its efficieny to manage the public order. This paper analyzing the legal bases for the creation of Basij and its development as an organ related to the management and guiding the social order, will consider its roles and functions in a legal viewpoint.
