نقش پليس در اجراي برنامه هاي عدالت ترميمي

The police role in restorative justice programs

با گذشت ساليان متمادي از اجراي مكاتب سنتي و كلاسيك، عدالت كيفري كه حاصل از توجه به جرم و بزهكار و در نتيجه بسط و توسعه عدالت سزادهنده در حالت اول و عدالت بازپروراننده در حالت دوم بود، بتدريج مشكلات اين روش كه ناشي از عدم توجه به بزه ديده يعني عنصر سوم پديده مجرمانه مي شد مشخص گرديد. جرم شناسان نيز در جهت رفع اين مشكلات ديدگاه هايي را مطرح كردند كه حاصل از توجه به بزه ديده مي شد كه امروزه به رويكرد بزه ديده محور معروف شده است. اين رويكرد در جهت قضازدايي و به منظور بسط عدالت غير كيفري مدل هاي گوناگوني را مطرح نمود كه بارزترين آنها مدل عدالت ترميمي است. در اين مدل سعي شده است با مشاركت دادن عناصر تشكيل دهنده پديده مجرمانه (بزه ديده، بزهكار و عناصر واسط) و با تاكيد بر جبران خسارت بزه ديده، مسيله فرايند جرم در محيطي غير قضايي حل و فصل شود. بدون شك پليس به عنوان يكي از اولين نهادهاي درگير در مقابل پديده مجرمانه كه مورد اعتماد بسياري از بزه ديدگان است، مي تواند نقش مهمي در اجراي عدالت ترسيمي را عهده دارگردد. در اين مقاله به بررسي مفهوم عدالت ترسيمي و تبيين برنامه هاي پليس در اجراي آن خواهيم پرداخت.

Over many years of performing classical and traditional schools of criminal justice that is result of considering the crime and offender and therefore developing rewarder justice in the first case and deterrent justice in the second case; gradually the problems of this method that are due to lack of attention to victim, namely is the third element of criminal phenomena was determined. Also to eliminate the problems, criminologists raised views and solutions that due to note to the victim that today is known as victim- centered approach. In order to de-judicial and to develop non-crimina justice, this approach proposed various models that most obvious model of them is restorative justice. In this model, it is has been tried to partnership with the constituent elements of criminal phenomena (victim, offender and interface elements) and with emphasis on compensation of victim, the issue of crime process be resolved in non-judicial environmental. No doubt, the police as one of the first institutions involved in criminal phenomenon tha has been trusted by many victims of crime can play an important role in the restorative justice. In this paper, we will investigate to the concept of restorative justice and will explain the police programs in its implementation
