Police reaction in certain circumstances of misdemeanor injury

بزه ديدگان آسيب پذير به عنوان طيفي از بزه ديدگان كه مستحق دريافت حمايت متناسب با وضعيت آسيب پذيري شان هستند، توجه پليس را در خصوص واكنشي مناسب، به خود معطوف داشته اند. مقاله حاضر بخشي از تحقيق است كه بين سال هاي 1388 تا 1389 انجام شده است. قلمرو مكاني تحقيق شهر تهران و شهرستان ري را در برمي گيرد. افراد جامعه آماري اين تحقيق قربانياني هستند كه پس از تحمل بزه ديدگي در دوره زماني يك ساله فوق به يكي از مراجع انتظامي شهرهاي مذكور مراجعه نموده و درخواست رسيدگي به پرونده كيفري خويش را داشته اند. از اين ميان تعداد 196 نفر بزه ديده به عنوان افراد جامعه نمونه مورد تحقيق قرار گرفتند. آسيب پذيري بزه ديدگان در شرايط خاص (خاص بودن مي تواند تحت تاثير مولفه ها و عوامل مختلفي از جمله نوع جرم، مكان و زمان ارتكاب جرم و يا جنسيت و قوميت بزه ديده باشد)، نظام هاي حقوقي را بر آن داشته است تا با هدف حمايت از اين گروه ها، به اتخاذ يك سياست افتراقي روي آورند. اين مقاله ضمن ارايه مجموعه اقدامات پليس در قبال بزه ديدگان جرايم، به ارزيابي وضعيت بزه ديدگان در شرايط خاص بزه ديدگي در دستگاه پليس مي پردازد. نتايج تحقيق نشان مي دهد كه واكنش پليس در شرايط خاص بزه ديدگي تابع اصل برابري و مساوات است نه اصل تناسب. به عبارتي پليس ترجيح مي دهد شرايط عامه بزه ديدگان را بر شرايط خاص آنان مقدم بداند.

Vulnerable crime victims, as a range of crime victims who are entitled to receive support commensurate with the status of their vulnerability, have attracted the attention of police about the appropriate reaction. This article is part of the research that was conducted between 1388 to 1389. The spatial domain of this Research is Tehran and the Rey city. Statistical populations of this research are victims that after suffering injury in the one-year period referred to one of the law enforcement authorities of listed cities and appeal to have his criminal record. Of these, 196 cases of victims were investigated as the sample population. Vulnerability to crime victims in certain circumstances (To be specific, can be influenced by various factors and components including the type of crime, location and time of the crime or sex and ethnicity of victim) has caused that legal systems with the aim to support these groups, adopted a differential policy. This paper presents a series of police actions against crime victims and assesses the status of crime victims in certain circumstances of misdemeanor injury in the police system. The results show that the police reaction in certain circumstances is a function of equality and equal principle and is not a function of proportionality principle.
