مبادي حقوقي اتحاد ملي در جمهوري اسلامي ايران و نقش بسيج در تحقق و تحكيم آن

A Legal Analysis on the Major Functions and Characteristics of the Basij Within the Community

وحدت ملي، نتيجه بلافصل ارتقاي سطح تعاملات انساني ميان اعضاي اجتماع و تحكيم سطح علايق و اعتقادشان به سرنوشت مشترك است كه نه تنها تنسيق امور عمومي را تسهيل مي‌كند بلكه بقاي روابط اجتماعي و اعمال اقتدار عمومي را در چارچوب جامعه سياسي از حيث روابط دروني و بيروني (حاكميت دولت و در دولت) تضمين مي‌كند. در شرايط كنوني جوامع كه تهديدهاي متعدد و مختلفي وضعيت مطلوب و بايسته و حتي موجود روابط جمعي را نشانه رفته‌اند، نه تنها تدقيق در مولفه‌هاي وحدت و اتحاد ملي براي جامعه ايراني ضروري است، بلكه حكايت از درايت و تعميق درك نقش اين امر در اقتدار و امنيت ملي دارد. در هر حال، با تاكيد مقام معظم رهبري بر اهميت محور اتحاد ملي در سال جديد، هر يك از نهادهاي عمومي بايد سهم خود را در اين خصوص به عمل آورند. به نظر مي‌رسد نيروي مقاومت بسيج به دليل خصيصه عمومي بودن بستر و موضوع كاركردهاي آن، بيش از هر نهاد ديگري مي‌تواند در اين حوزه نقش آفريني كند. در اين مقاله، با تكيه بر تحليل حقوقي نحوه شكل گيري و تعميق همبستگي، وفاق و اتحاد ملي را به ويژه با بهره گيري از عناصر حقوقي دخيل در آن و نقش بسيج در اين رابطه تحليل خواهيم كرد.

Coexistence or collective life is a principal natural character of the human being, and the society or community in spite of governed by the different considerations (natural, human, stable, dynamic, normative), is the necessary place to the co-existence. Insuring the social order and preventing disorders will depend on respect for those considerations for example understanding the social relations, their practical management and enforce the social norms. The Basij in light of both its creation process and functions, is a major social institution of the Islamic Republic of Iran who organizes the social relations and formed objectively correlations and interdependence of the legal and social orders. Therefore, comprehensive understanding of the Basij’s social functions will enhance its efficiency to manage the public order. This paper analyzing the legal bases for the creation of Basij and its development as an organ related to the management and guiding the social order, will consider its roles and functions in a legal viewpoint.
