رويكرد نظام عدالت كيفري به جرايم بسيجيان با تاكيد بر صلاحيت محاكم

The Penal Jsustice Approach tO Basijis’ Crimes With an Emphasis on the Tribunals’ Jurisdication

نيروي مقاومت بسيج از جمله رهاوردهاي انقلاب اسلامي‌است كه در عين پذيرش مسيوليتهاي ديگر، وظايف و مسيوليتهايي را در مجموعه سپاه پاسداران انقلاب اسلامي پذيرا شد. در اين نوشتاركوشش شده است با پرداختن به پويش تاريخي پديداري رسيدگي ويژه به دعاوي نظاميان و تبيين جايگاه قانوني بسيج در مجموعه نيروهاي مسلح، رويكرد نظام عدالت كيفري به جرايم بسيجيان و آيين دادرسي آنها به ويژه تاكيد بر صلاحيت محاكم، مورد مداقه قرارگيرد و برخي اصلاحات در قوانين موجود پيشنهاد شود.

Basij Resistance Force is among the achievements brought about by the Islamic Republic of Iran, which as part of the Armed Forces undertook roles and responsibilities in the IRGC while taking over other responsibilities. By considering the phenomenal- historical dynamism of especial investigation into the claims made by the military forces, and explaining Basijʹs legal standing within the Armed Forces, this article seeks to draw attention to the penal justice approach to Basijisʹ crimes and their legal procedures, especially the emphasis on the tribunalsʹ jurisdiction, and cause some modifications to be proposed in the existing rules.
