The Development of “Bidding to Honor and Forbidding Dishonor” to Promote National Involvement and Cohesion: Baseej’s Role and Initiative

امر به معروف و نهي از منكر نه تنها يك فريضه، بلكه يك نهاد حقوقي موضوعه در پرتو اصل هشتم قانون اساسي است. اين اصل، نظارت را به عنوان تكليفي همگاني تلقي كرده و در سه بعد مردم بر دولت، مردم بر مردم و دولت بر مردم مورد توجه قرار داده است. با توجه به اينكه تعميق و بسط اجراي اين فريضه و اصل حقوقي، يكي از كاركردهاي بسيج درحوزه امور فرهنگي است، در اين نوشتار مسايل مختلف راجع به نظارت ”مردم بر دولت“ در پرتو حقوق موضوعه مورد تجزيه و تحليل قرار گرفته است تا راهگشاي درك ابعاد حقوقي آن باشد. ضمن اينكه اين امر جزيي از تحليل ”همبستگي ملي و مشاركت عمومي“ است كه سال 1384 از سوي مقام معظم رهبري به همين عنوان ناميده شده است. به نظر نويسنده، كاركرد امر به معروف و نهي از منكر، محدود به نظارت بر مردم نيست و از اين رو، حوزه فعاليت بسيج بايد به ”نظارت دولت (بسيج) بر دولت“ و بسترسازي نظارت ”مردم بر دولت“ نيز گسترش يابد.

“Bidding to Honor and Forbidding Dishonor” is not only a religious duty, but also a legal institution enacted under the eighth principle of the Constitutional Law. This principle recognizes supervision as a general duty, considering it in terms of three aspects: people-to-government, people-to-people, and government-to-people. Whereas the development of the way this religious duty and legal principle id carried out, constitutes one of Baseej’s functions in the field of cultural affairs, this writing analyses different issues related to the “people-to-government” supervision in the light of the laws enacted, only to help understand it’s related aspects. Additionally, this is part of the analyses of “national cohesion and public involvement”, which was so phrased by the Supreme Leader. To the author, “bidding to honor and forbidding dishonor” is not limited to supervision over people, and hence, the activity area of Baseej should be developed to “government (Baseej) – to – government” and Paving the way for “people –to – government” supervision.
