تدابير راهبردي اينترپل ايران در بهينه سازي استرداد مجرمان

زمينه و هدف: امروزه حيطه ي امنيت كشورها تنها محدود به گستره ي داخلي مرزهاي آن ها نيست بلكه به واسطه ي توسعه فناوري، تسهيل شرايط حمل ونقل و كم رنگ تر شدن مرزها، مجرمان بسياري پس از ارتكاب جرم از خطوط مرزي محل رويداد جنايت گريخته و از اعمال قانون بر عليه خود جلوگيري مي نمايند. لذا با توجه به اهميت استرداد مجرمان به عنوان يكي از طرق توسعه امنيت و عدالت در سطوح ملي و بين المللي، هدف از تحقيق حاضر، شناسايي مشكلات و موانع موجود در اين راه و ارايه راهكارهايي جهت بهينه سازي و توسعه استرداد مجرمان مي باشد. روش تحقيق: تحقيق حاضر از نظر هدف، از نوع تحقيقات كاربردي و از حيث روش، توصيفي مي باشد. ضمن آن كه به منظور تجزيه وتحليل اطلاعات حاصله و استخراج راهبردها از روش چارچوب جامع تدوين راهبرد استفاده شده است. يافته ها: مطالعات حاكي از آن است كه مواردي چون موانع قانوني و نقص در قوانين موجود، كمبود هماهنگي لازم بين متوليان استرداد مجرمان، عدم انعقاد قرارداد با بسياري از كشورها، تشريفات خاص و گسترده ي اداري در روند استرداد مجرمان از عمده موانع اينترپل ايران در تسريع روند استرداد مجرمان است. نتيجه گيري: با توجه به نتايج حاصله، يكي از مهم ترين مولفه هاي تاثيرگذار بر استرداد مجرمان، داشتن روابط حسنه ي دوجانبه با ساير كشور ها است. بنابراين، اتخاذ راهبردهايي چون انعقاد قراردادهاي دو يا چندجانبه استرداد بين اينترپل ايران و ساير اعضا همچنين توسعه هماهنگي بين قوه قضاييه، وزارت امور خارجه و نيروي انتظامي همگام با توسعهروابط سياسي با ساير كشورها، زمينه ساز بسترهاي مطلوب جهت بهينه سازي استرداد مجرمان مي باشند.

Context and objective: Today the scope of security of countries doesnʹt limit to its extensive domestic borders rather, because of development of technology, facilitated situation of transportation the borders get less important. Many offenders would escape from borders of their crime committed location and would prevent observance of law against them. So with regards to importance of extradition of offenders as one of the ways to develop the security and justice in of levels of national and international, the purpose of present study is to discover the existence difficulties and hindrances in this path providing ways for optimization existent development of extradition of offenders. Methodology: The present essay uses practical research is descriptive. More over, in order to analyzing the gathered information & extracting strategies, this essay uses comprehensive frame work in complication of strategy. Findings: Studies show that cases in which these are juridical/ legal hindrances and defection in present laws. Less coordination between authorities of extradition of offenders, absence of contracts with many countries, especial and long bureaucracy ceremonies in process of extradition of offenders, are of main hindrances of Iranʹs Interpol in expedition of this process. Results: According to obtained results, one of the effective factors in extradition of offenders is having mutual amity with other countries. Therefore, getting strategies like sign/make/have a of mutual or multilateral contracts of extradition of offenders between Iranʹs Interpol and other members, and also, developing coordination between judiciary, ministry of foreign Affairs police force along side with developing political relations with countries, will be stepping stone for optimization of extradition of offenders.
