Peopleʹʹs Physical Privacy in the Mirror of Imamiah Jurisprudence and Iranʹʹs Laws

حريم خصوصي، قلمرو و محدوده‌اي از اعمال و ويژگي‌هاي هر شخص است كه براي عموم آشكار نبوده و در وهله نخست به فرد معيني اختصاص دارد و وي نيز تمايل به افشا آن ندارد. اشخاص هيچگونه ورود و نظارت ديگران بر اين فضا را برنمي تابند و نسبت به ورود غير، واكنش نشان مي دهند. اين مفهوم تاكنون در حقوق اسلامي و حقوق ايران به صورت مستقل مورد بحث قرار نگرفته است.قانونگذار ايراني نيز با عنايت به بيسابقه بودن اين سازه در فقه و حقوق ايران به صورت ناقص صرفاً به شناسايي برخي مصاديق اين حق پرداخته است.حريم خصوصي فيزيكي به عنوان يكي از ابتدايي‌ترين مصاديق حق بر حريم خصوصي به صورت پراكنده اي در قوانين مختلف مورد اشاره قرارگرفته است. اين مقاله، به بررسي وضعيت نحوه حمايت قانونگذار از حريم خصوصي فيزيكي اشخاص در فقه شيعه و حقوق موضوعه ايران،وطرح حمايت از حريم خصوصي مي‌پردازد.

Privacy is the realm and territory of every personʹs characteristics and behaviors which is not disclosed to the public and in the first stage, it is allocated to a particular person which he is not also inclined to disclose this privacy to others. People can not tolerate any kind of othersʹ entrance and supervision on this domain. They indicate reactions to the strangersʹ interference. This concept has not been discussed independently in Islamic and Iranʹs laws yet. Iranian legislators, considering the lack of past records about this structure in Iranʹs jurisprudence and laws, has just dealt with recognition of some evidences in an imperfect manner. As one of the most primitive evidences of the truth on privacy, physical privacy has been dealt with sporadically in different laws and regulations. The present study attempts to touch upon the conditions under which the legislator defends peopleʹs physical privacy in Shiite jurisprudence and the related laws in Iran and to discuss the protection bill of privacy.
