مطالعه تطبيقي ماهيت «ديات» در اسلام و «خسارت‌هاي تنبيهي» در آمريكا

The Nature of Diyat in Islam vs. Punitive Damages in the US: A comparative Study

امروزه جدايي دو حوزه «جرم و مجازات» از «خطاهاي مدني» امري ضروري است و موجبات مسووليت، ناگزير بايد در يكي از اين دو گروه طبقه‌بندي گردد و آثار آن‌ها نيز تابع قواعد عمومي آثار يكي از اين دو باشد. از اين رو، با ورود نهاد ديات به حقوق ايران، پرسش از چگونگي طبقه‌بندي آن در گروه نهادهاي حقوقي يا مدني مطرح شد. نظريه قايل به تلفيق ديات از عناصر هر دو گروه، برخلاف دو نظريه رقيب، مي‌كوشد كه به اين وسيله همه عناصر و آثار آن را توجيه كند. قايلان به اين نظريه جهت توجيه امكان برخورداري يك نهاد حقوقي از ماهيت دوگانه، به نهاد «خسارت‌هاي تنبيهي» در حقوق امريكا استشهاد مي‌كنند. اين نوشتار امكان برخورداري يك نهاد حقوقي – مانند ديه- از ماهيت دوگانه را مورد تاييد قرار مي‌دهد و به ميزان اشتراك و افتراق ديات و خسارت‌هاي تنبيهي مي‌پردازد.

Today it has proven essential to make a distinction between “crime and punishment” and “civil faults”, and the consent of responsibility must be categorized in either of the above two classes; hence, their effects must be a function of their general effects. It follows that with introduction of the institution of Diyat in the Iranian legal system, queries raise as how to classify and place if in the category of legal or civil institutions. Despite two other rival theories, a theory that regards admixture Diyat of the elements of both of the above classes, tries to justify all of its elements and effects. To justify benefiting a legal institution of a dual nature, proponents of this theory make reference to the punitive damages in the US legal system; the present paper endorses the possibility of a legal institution enjoying a dual nature and focuses on the rate of similarities and differences of Diyat and punitive damages.
