Surveying the Legal Ways to Guarantee Child Security in Unsafe Families

خانواده سالم، زير بناي تامين سلامت جسمي و رواني كودك مي باشد. در صورت وجود وضعيت مخاطره آميزبراي كودك در خانواده ناسالم ،آسيبهاي وارده به كودك غيرقابل جبران خواهد شد. تامين امنيت كودك يكي از مهمترين اهداف نظام حقوقي داخلي و بين المللي مي باشد. بررسي مباني قانوني دراين زمينه، بيانگر تحول قوانين داخلي به منظور نيل به اين هدف مي باشد. بر اساس كنوانسيون حقوق كودك مورخ 1989 ميلادي و پيمان نامه حقوق كودك و قوانين داخلي، نظير قانون حمايت از كودكان و نوجوانان مورخ 1381 و قانون حمايت از خانواده مورخ1391 و لايحه حمايت از كودكان ونوجوانان بي سرپرست يا بد سرپرست، راهكارهاي قانوني در ايجاد امنيت كودك در خانواده بيان شده است. در اين مقاله با استفاده از روش تحليلي و توصيفي، سوال اصلي تحقيق مبني بر نقش قانون در حمايت از كودكان در محيط خانواده ناسالم، مورد بررسي قرار گرفته و خلاهاي قانوني و اجرايي تبيين شده است.

A Secure family is the base of the physical and mental health of the child. If the status of the child is at risk in the unsafe family, the damages that the child suffers will be irremediable. Child safety is one of the main goals of the national and International community. The Study of national and international legal principles in this field indicates the development of legislation in order to achieve these aims. Providing child security in unsafe families was expressed in the convention on the Rights of the child dated 1989 , in the treaty on the Rights of the child and local laws including law on the protection of children and adolescents dated 2002 and Family Protection Act dated 2012, and the bill to protect Abandoned children or children of irresponsible parents.In this paper the main question of the research concerning the role of law in protecting children in unsafe families has been studied through analytical methods and the legal and implementation gaps have been explained .
