تبيين و نقد انگاره «عدم كارآيي مديريت فقهي در قبال مديريت علمي» با تاكيد بر ديدگاه امام خميني(س)

Critical Explanation of the Idea of Inefficiency of Jurisprudential Management versus Scientific Management With Special Reference to Imam Khomeini’s Viewpoints

: يكي از مهم ترين نظريه هاي سياسي ـ اجتماعي كه در طول تاريخ از سوي انديشمندان اسلامي عرضه شده، نظريه ولايت فقيه است كه با مجاهدت علمي و عملي امام خميني در قالب حكومت اسلامي، فعليت يافت. ايشان اين نظريه را كه تا آن زمان، در محدوده مسايل فرعي محبوس بود، از قلمرو فقه بيرون آورد و در جايگاه اصلي خود؛ يعني علم كلام نشاند. ظرافت موضوع ولايت فقيه و نوپايي طرح آن و تراوش ذهني انديشمندان از سويي، و هجوم فكري و فرهنگي بيگانگان براي ايجاد ترديد و تزلزل در آن، از سوي ديگر، سبب طرح پرسش‌ها و شبهاتي در اين زمينه گرديد، و ضرورت روشنگري بيشتر و نوپردازي قوي‌تر را نمايان ساخت. از جمله شبهاتي كه در اين زمينه مطرح است، شبهه «عدم كارآيي مديريت فقهي در قبال مديريت علمي» است. در اين مقاله با توجه به ديدگاه امام خميني در اين زمينه استدلال خواهد شد كه نه تنها مديريت فقهي در تقابل با مديريت علمي نيست بلكه مديريت فقهي نوعي از مديريت علمي است. ضمن اينكه دين اسلام، در مجموعه دستورات خود، مكانيزم لازم براي اداره جامعه را داراست، در غير اين صورت كامل بودن دين اسلام كه از مسلّمات معارف قرآني است، مورد خدشه قرار مي گيرد.

One of the most important sociopolitical theories introduced by Muslim thinkers in the course of history is the theory of Guardianship of Jurisprudent (Wilayat Faqih), which was implemented through scientific and practical struggles of Imam Khomeini in the form of Islamic government. The idea was confined to secondary principles until his time, but he removed it from the realm of jurisprudence and placed in its real status, i.e. the domain of theology. The novelty of the idea of Guardianship of Jurisprudent on the one hand and intellectual and cultural attacks of aliens against this idea to create some doubts about it on the other hand are the main reasons for this research. Hence, the present paper is an attempt to provide answers to the questions raised about this issue and also shed light on its different aspects. One of the questions raised in this regard is the inefficiency of jurisprudential management versus scientific management. The hypothesis of the present research is: based on Imam Khomeini’s viewpoints not only jurisprudential management is not in confrontation with scientific management, but also jurisprudential management is a kind of scientific management. At the same time, Islam has the necessary instructions for management of the society, otherwise, the perfectness of Islam which is among the definite teachings of the Quran would be put to question
