The Iran Criminal Legislative Policy for the Preservation of Water Resources with Regard to the International Instruments

حيات انسان و ماندگاري او در كره زمين، به بهره برداري از منابع مختلف از جمله آب وابسته است. استفاده نادرست از منابع محيط زيست، آلايندگي و تخريب آنها را در پي خواهد داشت. آب به عنوان يكي از حوزه هاي بسيار حساس محيط زيست كه حيات بشر به آن وابسته است، در معرض انواع آلاينده هاي زيست محيطي قرار دارد. حراست و صيانت از سلامت منابع آب ضرورت مداخله و استفاده از راهكارهاي حقوقي و كيفري در به سامان كردن استفاده از آنها را ايجاد كرده است. سياست كيفري داخلي در حوزه تقنين با الهام از احكام شرعي همزمان با ملاحظات بومي و ملي براي پاسداشت منابع آب، به صورت مستقيم و غيرمستقيم از الزامات ناشي از الحاق به اسناد بين المللي تاثير گرفته و مقرراتي در صيانت از منابع آبي بزرگ و كوچك مصوب كرده است

Human life and his survival on the earth are dependent on the utilization of the different sources like water resources. Misusing of the environmental resources can result in pollution and destruction. Water, as a very sensitive environmental resource on which human life depends, will be exposed to all kinds of environmental pollutions. The necessity of preservation of the water resources has been engaged in legal and criminal strategies which are passed in order to save and protect these resources. Internal criminal policy in the field of legislation with regard to religious order and the national and local considerations has focused on respecting water resources. This policy has directly and indirectly been influenced by the application of the requirements of joining to international instrument regulations, and has passed laws to preserve different bodies of water resources
