نظريه ابتناي توسعه اجتماعي بر سرمايه حقوقي

THEORIZING THE RELATIVITY OF SOCIAL DEVELOPMENT ON THE BASIS OF LEGAL CAPITAL

سرمايه حقوقي، ناظر به روح انضباطي حاكم بر روابط شهروندان جامعه در چارچوب‌هاي معين در عرف و قانون مرسوم هر اجتماع است. براساس اين ديدگاه، امكان توسعه اجتماعي در جامعه‌اي كه فاقد سرمايه حقوقي است، اساساً بي‌معناست و سرمايه حقوقي در اجتماعي شكل مي‌گيرد كه وضع حقوقي پيش‌تر در آن استقرار يافته باشد. با اين فرض، طبعاً وضع حقوقي و حاكميت قانون نيز حكايت از گذار موفق از وضع طبيعي به وضع مدني دارد. به اين اعتبار، طبيعتاً فرضيه اصلي مقاله حاضر در پاسخ به پرسش امكان‌سنجي ايجاد توسعه اجتماعي بر بستر سرمايه حقوقي، معتقد است كه بدون سرمايه حقوقي، وجود هر نوع توسعه اجتماعي انسان در جامعه باثبات نيست. به ديگر سخن، تحقيق حاضر قصد دارد ضمن بيان چيستي سرمايه حقوقي، توضيح دهد كه چگونه سرمايه حقوقي به‌عنوان يك متغير مستقل نقش كليدي در ايجاد و نهادينه كردن توسعه اجتماعي در يك جامعه برعهده دارد.

Legal capital refers to the disciplinary spirit governing the relations among citizens within the frameworks defined by societies’ statutory and customary law. Based on the present view, any social development is meaningless within a society which lacks legal capital, i.e. legal capital is formed in societies where the rule of law is previously established. Therefore, rule of law indicates a successful transition from a natural state to a civil state. This paper is an attempt to examine the possibility of making social development relative to or dependent upon legal capital, and postulates that without legal capital any establishment of social development is unfounded and unreliable. The present article defines the concept of “legal capital” and explains the processes where, as an independent variable, it establishes and further institutionalizes social development in societies.
