مباني فقهي و حقوقي مشروعيت ضمان دولت در پرداخت خسارت ناشي از كاهش ارزش پول

Juristic and legal basics of legitimacy of state guarantee in the loss compensation resulting from currency depreciation

گاه دولت با اتخاذ بعضي از رويه هاي اقتصادي يا سياسي موجب كاهش ارزش پول و در نتيجه تورم شده و به دليل كاهش ارزش دارايي هاي مالي و قدرت خريد، به گروه هاي مختلف جامعه خساراتي وارد مي گردد. ضمان مسبّبين و مباشرين كاهش ارزش پول وتورم، جزو موضوعاتي است كه مورد ترديد و اختلاف فقيهان و حقوقدانان قرار گرفته است. در اين جستار اثبات شده است كه دولت در صورت تحقق شرايط ضمان، مسوول پرداخت خسارت ناشي از اعمال و تصميم هاي زيان آور خويش و ملزم به جبران آن است و از آنجا كه اشخاص حقوقي جز در مواردي كه اختصاص به طبيعت انساني و ذات او دارد، مانند اشخاص حقيقي موضوع هر حق و تكليفي قرار مي گيرند، مباني و ادله ي ناظر به ضمان اشخاص حقيقي، به ضمان دولت به جبران خسارت ناشي از كاهش ارزش پول نيز تعميم داده شده است. قاعده عدالت، قاعده حرمت مال مسلمان،حفظ امنيت اقتصادي و نظم عمومي به عنوان مباني عام، و قاعده هايي چون اتلاف، لاضرر، و تسبيب در شمار مباني خاص اثبات اين نوع از جبران خسارت، قلمداد شده و مورد استناد قرار گرفته اند. بر پايه يافته هاي اين پژوهش، چنان چه دولت با اقدام هايي از قبيل چاپ اسكناس بدون كارشناسي دقيق يابي پشتوانه يا با ايجاد مناقشات سياسي و دامن زدن به اختلافات داخلي و جناحي، موجب بروز مشكلات اقتصادي، و در نتيجه كاهش ارزش پول و اضرار به مردم شود، ضامن است و بايد خسارات وارد شده را جبران كند.

Guarantee of agents and persons responsible for currency depreciation and inflation is including subjects that jurists and lawyers hesitate and disagree with it. In this paper, it is proved that in case of realization of guarantee conditions, government is liable for damage resulting from its detrimental actions and decisions, and obliges to compensate it. Since corporate bodies, in other than those cases appropriated to human nature and essence, like real persons, included in any right and duty; thus basics and reasons about the guarantee of real persons generalize the government guarantee of compensation resulting from currency depreciation. Rules of equity, sanctity of Muslim property and public order as the public basics, and rules such as wasting, no loss and being the cause are considered special basics for proving this kind of loss compensation and are referred to them. On the basis of findings of this research, if government, by actions such as fiduciary and without expertise issue of banknote or by making political disputes and initiating internal and factional divergences, causes the economic problems, and as a result, currency depreciation and cause a loss to people, is guarantor and have to compensate the loss.
