انديشه اضطرار گرايي در مصاف با نظريه تعادل

The Theory of Exceptionalism Facing the Theory of Balance

حق و مصلحت ازجمله مفاهيمي هستند كه بر مباحث سياسي، اخلاقي، حقوقي و اجتماعي اكثر كشورهاي دنيا حاكم شده اند. با اينحال، وجود ناهماهنگي ميان اقتضايات تضمين حقوق فردي و ارتقاي مصلحت عمومي موجب مي شود كه بروز حدي از تنش ميان اين حقوق و آن مصالح، گريزناپذير باشد. پژوهشگران، ضمن اتخاذ رويكردهاي نظري مختلف درباره نسبت ميان حق و مصلحت، راهكارهاي متفاوتي را براي حل اين تعارض مطرح نموده اند. پاره اي از آن ها با طرح ايده حاكميت حق، بر اولويت حقوق فردي تاكيد نموده و برخي ديگر، مصلحت عمومي را داراي تقدم رتبي قلمداد كرده اند. در ميان طرفداران نظريه تقدم مصلحت، عده اي با طرح انديشه اضطرارگرايي بر عاديشدن وضعيت اضطراري بهويژه پس از وقوع حوادث 11 سپتامبر 2001 تاكيد نموده و ضمن مقدمدانستن منافع جمعي نسبت به حقوق و آزادي هاي فردي، خواستار اعطاي قدرت بيشتر به دولت جهت محدودسازي حق ها شده اند. در اين نوشتار تلاش خواهد شد تا پس از نقد انديشه اضطرارگرايي، ايده تعادل را به مثابه نظريه اي همگرا در خصوص نسبت ميان حقوق فردي و مصالح جمعي معرفي شود.

The concepts of right and expediency are two of the concepts that have been governed over political, ethical, legal and social discourses in the most of countries. However, due to the heterogeneity of the protection of the individualʹs rights requirements and the improvement of the general interest, the appearing of an extent of conflict between these rights and those interests is inevitable. The researchers with various viewpoints about relationship between right and public interest have presented different solutions for such a conflict. Some of them have presented the idea of right authority and insisted on priority of rights and some other have regarded the public interest as a superior consideration. Some of resent theorists— by introducing the theory of exceptionalism— have insisted on this idea that we are facing the “normalization of emergency conditions” specially since 9/11 and asked for offering more authority to the state in order to restrict the rights while believing that public interests have precedence over the individual’s rights and freedoms. In this essay, we will attempt to criticise the theory of exceptionalism and then introduce the theory of balance as a convergent theory about relationship between individual rights and collective interests.
